The former President of the Supreme Court and the then Minister of Finance requested favors from each other in the spring of 2020 at the expense of their official powers - Darko Radunović asks her for help in a court case, and Vesna Medenica He thanks him the day after for hiring "the little one".
Asked to comment on this, Radunović told Vijesti yesterday that he had no comment.
He served as Minister of Finance as a member of the Prime Minister's government. Duško Marković.
Medenica is accused of being part of her son's criminal group. Milos Medenica, which, according to special prosecutors, smuggled cigarettes and illegally influenced court decisions.
The messages from her phone are part of the case file, and Vijesti has access to them.
"Vesna, please, if there is any chance that something can be done after the verdict in the case Duško/Krcun Radunović "You would do me a great favor with Judge Stanka V.... I don't know legally if there is a chance, but if there is, please take advantage of it.. Thank you in advance and sorry for your absence..", Radunović wrote to the then President of the Supreme Court on May 7, 2020.
Two minutes later, she replies that he needs to give her the case number and says:
“I didn't know about the subject???”.
"UV 1848/18 judge Stanka Vučinić", help if you can because it's really needed...", he wrote.
That day and the next, the two exchanged several more messages about the case, and after the judge wrote that they did not have a file in the name of the party, Radunović Duško, in the records, he explained:
"It's in the name of his company Stan projekt, but I'll ask you for the case number..."
His tax is disputed.
The court case he was interested in concerns a request to review the legality of the Administrative Court's judgment, which rejected the lawsuit filed by the Stan Projekt company against the Ministry of Finance's decision in the year before their correspondence and determined that the plaintiff was required to pay VAT in the total amount of 210.855,36 euros and pay the difference of 99.340,71 euros, with the calculation of default interest of 1.960,95 euros.
In April 2019, the Supreme Court rejected this request as unfounded, which made the company's obligation to pay more than 99 thousand euros to the state for the difference in calculated and paid value added tax (VAT) for September 2015 legally binding.
The ruling states that the Administrative Court correctly assessed all the facts and lawfully confirmed the decision of the Ministry of Finance, which ordered Stan Projekt to pay the VAT debt, along with default interest of almost 2.000 euros.
The central issue in that administrative dispute was the existence of works on cadastral plot number 366 in the town of Pržno - Kamenovo, where Stan Projekt claimed to have invested, and the company M&P Engineering from Danilovgrad was carrying out the works based on a contract from April 2015.
However, as determined in the administrative proceedings, no construction site was found on the ground, and the contractor had no input VAT declared, nor did he submit VAT returns for the disputed period.
Therefore, it was concluded that the works under that contract were not carried out, and that Stan Projekt unfoundedly attempted to exercise the right to deduct input VAT.
In its request, the Stan Projekt company referred to annexes to the contract and other investments at various locations, but the court found that these allegations were irrelevant to the decision in question, as the dispute related exclusively to the plot in Pržno where no work had been carried out. It was determined that the company had already exercised its right to deduct VAT for other locations.
The Supreme Court concluded that there was no violation of procedure, that the Administrative Court provided clear and valid reasons for its decision, and that there were no grounds for its annulment or modification.
Pressed from every side
A month and ten days after he sent her a message asking her to look into the case if she could, Medenica sent Radunović the following on June 22 of that year:
"Thank you so much for the little one. She started today. I spoke to Krcun and we clarified everything. Pozzzz," to which Radunović thanked her.
Already in July of that year, he sends him the information and a message: "ID 36*** Darko, please pay me my income. It's important to me, because I'm pressed on every side. Pozzz".
He also asks for a favor on October 6, when he writes to him that he has a final request for "brother policeman", whose name he writes:
"...Who is requesting a mutually agreed termination of employment. You have had the severance pay decision for a long time. Please, this is important to me. I hope you are all well. Pozzzz".
"The cabinet is in progress... I'll be in touch," he writes, adding later that day: "I checked and it will be OK, we have secured funds for severance pay"...
Resignation, then arrest
On December 30, 2020, Medenica resigned from her position as President of the Supreme Court, which she had held since 2007.
She did this under political pressure because she was unconstitutionally elected to a third term.
Two years later, she was deprived of her liberty at Podgorica Airport, while boarding a flight to Belgrade.
She was handcuffed on suspicion of being a member of a criminal group formed by her son Miloš Medenica.
The Special State Prosecutor's Office charges him with creating a criminal organization in 2019, whose members included his mother Vesna and other defendants, with the aim of smuggling cigarettes and illegally influencing the judiciary, in order to gain illegal profit and power.
According to the indictment, he, in complicity with the accused members of the criminal organization, evaded customs supervision measures and smuggled cigarettes from the Free Customs Zone of the Port of Bar using false documentation and bribing customs officials.
The former prosecutor and long-time head of the Supreme Court of Montenegro has repeatedly denied guilt.
Part of the case filed against her and the criminal group formed by her son includes correspondence from her phone, which shows that she often issued illegal orders to her colleagues.
