The Bijelo Polje Higher State Prosecutor's Office is still investigating a case in which it was recently determined that cocaine seized 17 years ago was not cocaine.
As the institution told "Vijesti" yesterday, the procedure is in the investigation phase, the expert reports have not been completed, and a decision has not been made.
In early April, they opened a case to determine what happened to a kilogram of cocaine in the depot of the local High Court, which was ready to be destroyed, but this did not happen because preliminary analyses showed that it was not that psychoactive substance.
Vijesti announced in early April that representatives of the Commission for the Implementation of the Destruction of Legally Seized Drugs at the Bijelo Polje High Court tested the drugs scheduled for destruction, when it was discovered that the substance, for which two people had served multi-year prison sentences, did not actually react to rapid drug tests...
"The State Property Administration of Montenegro submitted to this prosecutor's office a notification and minutes on the implementation of direct control of drugs scheduled for destruction at the High Court in Bijelo Polje, drawn up by the Interdepartmental Commission for the Implementation of the Destruction of Legally Seized Drugs at the High Court in Bijelo Polje, which listed certain irregularities during the control of the material. The High Court in Bijelo Polje also notified this prosecutor's office of the same event. The High State Prosecutor's Office in Bijelo Polje has formed a case, and the investigation is ongoing," the newspaper was told at the time by the High State Prosecutor's Office, which it heads. The Bijelo Polje High Court said that the commission submitted the minutes to them on March 28th of this year and that the evidence from the aforementioned proceedings will not be destroyed, but rather the competent authority will be notified in order to clarify the situation and definitively determine the properties of the substance seized in April 2008, which did not show the expected color.
The seized substance originates from a case against RM i EM who were found guilty in 2010 of the criminal offense of criminal association and unauthorized production, possession and distribution of narcotic drugs and sentenced to eight years and eight months, respectively to seven years and eight months in prison.
Then, as the Bijelo Polje High Court said, they were ordered to permanently confiscate the substance - 1.000,40 grams of cocaine with a concentration of 79,5 percent, which was ordered to be destroyed after an expert examination upon the finality of the verdict.
"By the judgment of the Appellate Court of Montenegro, Ksž.br. 26/11 of 8. 11. 2011, the aforementioned judgment of this court was modified in terms of the legal assessment of the offense and the decision on the sentence, and the accused were sentenced to single prison sentences, namely the accused MR for a period of 6 years and 6 months, and the accused ME for a period of 5 years and 6 months, in which their detention is included. The convicted persons were in detention since 26. 4. 2008, and they began serving their sentences on 26. 1. 2012. The same court accepted the applications for conditional release, so the convicted RM was released on 30. 5. 2014 and the convicted EM on 9. 4. 2012," the Higher Court said.
