He said this in the Bijelo Polje Higher Court, before which, as a second-instance body, a hearing was opened against Kukaj in the case of the Basic Court in Berane.
Kukaj is charged with the criminal offense of constructing a building without a building permit and documentation.
According to the indictment, in November 2020, as an investor, he continued to build a commercial and residential building in the town of Bedluci, even though a decision was issued by the Chief Republic Inspector for Pljevlja and Žabljak, Zorica Čolović, to ban construction.
"The local inspection, by reviewing the documentation and visiting the site, determined that Kukaj has a building permit, which was issued in 2014, when Gusinje was an independent municipality, and it was the municipality that was competent to issue the permit, not the Plav Municipality, as was the case here, which is why we informed the building inspection, because the local one is not competent. We were informed by the building inspection that all measures and actions have been taken, that the aforementioned person has a building permit, that further construction has been suspended until the necessary conditions are met, and we still do not know what happened in that case," said Pirović.
He also said that he was not familiar with the role. Tahira Đonbaljaj in that case, but to know that during 2014 he was employed in the Municipality of Plav.
Kukaj said that he did not receive a decision prohibiting construction and complained that he knew Pirović and that they lived nearby, but that he had never told him that there was a problem with the construction until he was informed by the Prosecutor's Office.
Kukaj's defense attorney, lawyer Muamer Suljevic He objected to the statement, pointing out that it was contradictory, that Pirović said that they did not take any official action, and then that he was making an official note.
He stated that he was concealing facts relating to Djombaljaj and that he was swallowing dumplings while giving his testimony, which shows a symptomatic picture of concealing facts.
Kukaj said that he was never served with a decision prohibiting construction and that the signature on the acceptance decision was not his.
State Prosecutor Marko Bojović He pointed out that a misdemeanor proceeding was conducted in the Misdemeanor Court, during which he did not dispute that he had received the aforementioned decision, while attorney Suljević said that "the facts in the explanation of a case cannot serve as evidence."
Kukaj previously said that he was not guilty, that he received a building permit for construction from the Municipality of Plav in 2014 (for the construction of a floor, attic and business premises), and that he carried out the work in accordance with the law from that period, emphasizing that in his case it was the policy of the leaders of the Municipality of Gusinje, who "hit on certain people" and that he was a victim of a slightly stronger group of politically powerful people in the Municipality of Gusinje, together with the former Mayor of the Municipality. Construction inspector Zorica Čolović did not attend yesterday's hearing due to a previously announced trip abroad, so a new hearing was scheduled for June 18th.
