Olivera Krivokapić, former head of the Branch for Administrative Affairs, Citizenship and Foreigners in Cetinje, reacted to today's allegations by the acting director of the Police Administration, Lazar Šćepanović.
"Mr. Šćepanović, I am surprised by the level of your ignorance of legal regulations. I ask you a simple question: is an administrative procedure initiated based on a notification that a criminal report has been filed? A criminal report does not initiate a criminal, let alone an administrative procedure. It is handled exclusively by the prosecutor's office, or the police upon the prosecutor's order. The prosecutor's office and the police are responsible for the implementation of a justified criminal report (for conducting searches, confiscating weapons, as well as other actions). To be very clear - a notification of the filing of a criminal report to the Branch means absolutely nothing if we adhere to the law, and I guess we should. Your claims about 'who should have done what' are in no way supported by the applicable legal provisions," she said.
She said that the Branch operates solely on the basis of the law, not assumptions or guesswork.
"Do I really have to quote the Law on Weapons to you? You obviously don't know when an administrative procedure for the confiscation of weapons is initiated, who is authorized to make an official note, and how it is determined whether there is a risk of weapon misuse. Do you know: who collects operational data? Who acts preventively? Who keeps records of temporarily seized weapons? Who is authorized to temporarily seize objects, acts on orders from the prosecutor's office? Why don't you ask yourself why the Police Directorate did not submit the legally prescribed data to the Branch? Those who are legally authorized to do something — do not need to be reminded. If you really wanted to, you would have discovered who prevented the search at Borilović's and why it was not carried out. Do I have to explain to you what 'urgent action' in cases of violence means? The word 'immediately' means — now, without delay. What would the police do if at one o'clock after midnight I took a pole, smashed a car, attacked someone, threatened, shouted? The answer is clear," she adds.
He says that "even laypeople know" how the police should react.
"Also, I expect you as a serious person to: submit a gun license, a request or any document proving that any citizen of Rožaje was issued a document in Cetinje. I claim for the umpteenth time - that is not true. If you made that claim from some police record, that record is not valid. Simply put - it is not possible to issue a document to a person without a residence in Cetinje. You should know that. Prove the opposite. Show me that document. Believe me, you cannot lecture me on laws and jurisdiction. I work exclusively according to the law, and I have disputed all allegations with evidence in court. Do you even know what a seller's certificate of sale of weapons represents? I advise you again: read the laws. Your subjective conviction that I 'should have done something' - is not valid if it is not supported by regulations. Laws are there to be respected, whether we like them or not. Finally - you did not mention my name. Why? I am not hiding. I announce myself publicly, clearly and loudly. I have always done my job honestly. "I will not have a discussion with you on portals, but in designated places," said Olivera Krivokapić.
