The Court of Appeal of Montenegro announced that today it publicly announced the verdict by which it modified the verdict of the Higher Court in Bijelo Polje K. No. 8/24-22 of May 13, 2024, by declaring the accused MV guilty of the continued criminal offense of unlawful sexual conduct and sentencing him to five years in prison.
"The decision was made and publicly announced after a hearing before the Court of Appeal of Montenegro in the procedure for deciding on the appeal of the Higher State Prosecutor's Office and the attorney of the injured party. The Higher Court in Bijelo Polje has twice issued a verdict acquitting the accused of the charges, because according to that court, it has not been proven that the accused committed the aforementioned criminal offense," the statement states.
The Court of Appeal added that for the first time, the court overturned the first-instance verdict and returned the case to the first-instance court for a new ruling, while for the second time, it overturned the first-instance verdict and sentenced the defendant to five years in prison.
"The judgment of the Court of Appeal of Montenegro Kž. No. 135/24 with reasoning will be drafted within the legally prescribed deadline, after which it will be published on the website of this court," the Court of Appeal said.
