According to the claims of the Special State Prosecutor's Office (SDT), that message on the Sky telephone program was sent by Lazar Ilić, one of the accused members of the criminal organization that planned to kill Marko Ljubiša from Budva.
The special prosecutors state that he sent that phone message on the first day of 2021, and then sent the same interlocutor a photo of a "Glock" pistol, which was confiscated from him by police officers about twenty days later after a search of his apartment in Budva...
"I swear, brother, you'll see, I'll drill him like a tree in the sky, hahahaha...", Ilić continues the communication.
The SDT filed the indictment in early March 2025, and it states that the criminal group was created by Radoje P. Zvicer, a resident of Kotor, and Nikola V. Vušović, aka Džoni, from Vračar.
The members of that organization are Mario M. Milošević from Podgorica, Radovan L. Mujović from Nikšić, Ivan Z. Biletić from Berane, Aleksandar B. Ćetković, permanently residing in Budva, Davor S. Kordić with temporary residence in Budva, Damir S. Mandić from Podgorica and Branko R. Simić from Užice...
The indictment alleges that in the second half of 2020, Zvicer and Vušović organized a criminal group that planned to kill Khan in January 2021.
It is explained that Bletić was tasked with ensuring that Savić and Ilić entered the territory of Montenegro from Serbia outside border crossings, avoiding border control, and placing them in safe locations: "In order to carry out their tasks in the territory of Budva, which were assigned to them by the organizers of the criminal organization."
Kordić's task, according to the SDT document, was to collect information about the most suitable place to kill Ljubiša Marko, known as Kan, and people close to him, then about the buildings in which they were staying, to photograph these locations, and to inform the organizer of the criminal organization about the information collected.
The prosecution's document states that Ćetković's task was to form a group with other members of the criminal organization, including Strahinja Savić, on the encrypted "Sky Ecc" phone application, so that everyone would be informed in group communication when Savić arrived in Montenegro.
According to the same allegations, Mandić procured and brought into prison encrypted phones with the "Sky" application for members of the criminal organization, while the defendant Simić was tasked with carrying out the instructions and orders of the organizers of the criminal organization.
In his defense before the SDT, Mario Milošević denied that he had committed a crime and said that he could not be a co-perpetrator of a crime with people he did not know.
He stated that it was not clear to him that he had been following anyone while he was in prison. He also stated in his defense that he had never been in possession of, nor used, an encrypted phone.
Biletić also denied guilt, while Mujović stated that he had never used any encrypted phone, as he has been in prison for five years.
The defendant Ćetović also denied that he used an encrypted phone, and that he was not even in Montenegro during the aforementioned period.
In his defense on the record before the Special State Prosecutor's Office in November 2024, Mandić denied guilt, emphasizing that he had not committed any actions aimed at committing a criminal offense as a member of a criminal organization.
Who's who on Sky?
Prosecutors, it is written, conclude from the content of these communications that Zvicer used an account on the encrypted Sky application...
They state that from the order cited in the indictment, he sent another member of the team a selfie photo, which shows a male face in a mirror with a beard, who has scars on his chest and left and right arms...
"On which photo, the user of the pin JD47MN sends him a message with the following content: 'Wow, how you burned up'. After which... Radoje Zvicer sends: 'That's easy, but what I am like'. After which the user of the pin JD47MN replies: 'Hey, what, it's nothing, don't joke, just don't hurt anything. What kind of life do you want to be after so many bullets. Come on, don't make fun of yourself, it's all great, man. Thank God'."
It is added that Zvicer sent messages via the encrypted application even after his son was born at the end of December 2020. He responded to the congratulations with messages: ... "Tonight we sing alone. Tomorrow Tanja Savić. The day after tomorrow Jadranka and another awesome guy from PG. Well, you see when."
The prosecutor also states that they analyzed the PIN used on Sky by Vušović, who, among other things, wrote to a group associate in a chat on March 7, 2021: "Now they're announcing that tomorrow they'll be the main topic in Kurir," and then they continue to comment on the announcement by the state of Serbia that it will deal with the Velje Nevolje group (Veljko Belivuk), but also their criminal successors, including Džoni Vušović.
SDT concludes that Damir Mandić was a user of the pin account M9DA8V on the “Sky Ecc” application based on communications with other users...
"It is alleged that on July 6, 2020, he sent a message to an unidentified person: "... I received a final judgment this morning to pay Duško's wife 15 in 37.000 days."
The prosecutor concludes that it is a well-known fact that Mandić was convicted by a final verdict for the murder of journalist Duško Jovanović.
Ilić and Savić recalled police torture in court
Ilić previously denied committing the crime in the Podgorica Higher Court, saying that he did not come to Montenegro to kill Khan, but because of problems he had in Serbia.
He also denied being a member of a criminal group.
"I do not know Marko Ljubiša Kan. I am not a member of any criminal organization. I was tortured by the police when I was arrested. Plainclothes police officers beat me on the head with a pistol. They told me to say that I fell. The earlier statement of the accused Strahinja Savić is incorrect. I assume that he was also beaten by the police, which is why he made such a statement," the accused said at the time.
He added that the police officers he said beat him said they were going to kill him.
At that time, in the Podgorica Higher Court, Savić also denied his earlier statement given to the Special State Prosecutor's Office, when he explained in detail the planning of the criminal act.
"I was forced to make that statement at the time. I was tortured in the police. They threatened me. I saw that they were beating Ilic too. I assumed that would happen to me too and who knows what else. They told me: 'We know everything' and to admit what they were saying. They gave me a picture of a man to recognize... I didn't come to kill anyone," claims Savic.
Kan: I don't know any of the attackers
The injured party witness Ljubiša Marko, in his testimony before the prosecution, stated that he did not know any of the defendants and that it was not clear to him what they had against him, because he had nothing against them.
He said he had no arguments with any of the defendants, from the perpetrators to the ones who ordered the killings, and emphasized that he literally did not know them.
He said that at the time he had, and still does, an armored Mercedes, explaining that the latest attempt to assassinate him was just one in a series.
He stated that in August 2019, his two close friends, Goran Slovinić and Dragan Marković, were wounded on the terrace of a bar in the Old Town of Budva.
He said he was aware that he was the target, but that he avoided the attack at the time.
Before that, he said, he was wounded twice, in 2009 and 2013.
He stated that he was not joining the criminal prosecution against the defendants and did not make a property claim.
