Lawyer Nikola Tomković announced today that detainees at the Remand Prison at the Directorate for the Execution of Criminal Sanctions (UIKS) in Spuž are once again announcing a hunger strike.
"Namely, the earlier agreement that the detainees reached with the President of the Higher Court Zoran Radović, representatives of the Ministry of Justice and the Ombudsman - Protector of Human Rights and Freedoms Siniša Bjeković, remained just an empty promise. Everything that was agreed upon has not been implemented in practice, and at the same time, some judges from the Higher Court have no information about the agreement reached," Tomković stated in a letter sent to "Vijesti", saying that he was addressing the matter in his capacity as the defense attorney of the detained Milan Brajović.
He said that the detainees are once again pointing to the things that were agreed upon during the first hunger strike as a form of protest, a month and a half ago, which are:
1) To verify every ground for detention – detention is ordered without verification;
2) To review the grounds for detention under point 4, which is unlawful;
3) That the judgment of the European Court of Human Rights – Labita v. Italy, with the detention grounds of point 3, be applied;
4) To respect the Law and Constitution of Montenegro;
5) That the right to defense and a fair trial will be respected;
6) That the Court of Justice of the EU in Luxembourg and the European Court of Human Rights will be respected;
7) That the courts will determine the amount of bail;
8) That they will review indictments for the same time period, where the same people are mentioned for two organizations – merge them;
9) That the application of the so-called nanogica - electronic surveillance - will begin.
"The situation in detention units is extremely bad, there is a large number of detainees, lawyers wait several hours to see their clients, family visits are still delayed for a long time, the grounds for detention are not being checked, which was agreed upon at a meeting during the previous hunger strike, judges do not propose bail - guarantees for release because the judges justify that they have not received any notification," said Tomković.
He stated that the detainees are given 15 days to sign a new agreement, which would involve some lawyers to formulate an agreed-upon deal.
"If the Supreme Court and the Ministry of Justice do not react within the specified period, a new hunger strike will be launched, with some additional activities, to force the authorities to do their job. Also, the families of the detainees will join in peaceful protests in front of the High Court, and the detainees will also demand the resignations of the people responsible for this situation," said Tomković.
The previous hunger strike by detainees in the Remand Prison began on April 10, when 163 people went on strike.
On April 17, UIKS announced that everyone had ended the hunger strike.
