At the panel session on June 12, the Court of Appeals rejected as unfounded the appeal of defense attorney Danilo Mandić against the decision of the Higher Court in Podgorica dated May 16 on the extension of the defendant's detention.
The higher court, they remind, extended his detention, considering that Mandić's previous convictions for multiple criminal offenses, including criminal offenses with elements of violence, represent a circumstance indicating that, if released, he would repeat the criminal offense, thus hindering the further conduct of the criminal proceedings.
It was determined that Mandić's detention will last until July 20, at 00:40.
"The Court of Appeal of Montenegro believes that the lower court correctly concluded that in this specific case the substantive and legal presumption to extend the detention of this defendant was met, that is, that there is a reasonable suspicion that he committed a criminal offense, and that the first-instance court correctly determined that the fact that he had previously been convicted several times, including for criminal offenses with elements of violence, constitutes a valid basis for extending the detention of this defendant on the basis of the provision of Article 175, paragraph 1, item 3 of the Criminal Procedure Code," the Court of Appeal announced.
The Higher State Prosecutor's Office in Podgorica previously assessed that the actions of Danilo Mandić - nephew and informal bodyguard of parliament speaker Andrija Mandić - did not meet the elements of the criminal offense of attempted aggravated murder, for which an investigation was conducted.
As they said at the time, the evidence collected in this specific case indicates criminal offenses not within the jurisdiction of that prosecutor's office, which is why the case was forwarded for further action to the Basic State Prosecutor's Office in Podgorica.
They also said at the time that the evidence collected indicated that criminal offenses had possibly been committed - causing general danger, serious bodily harm, and illegal possession and carrying of weapons and explosives.
The Podgorica Higher State Prosecutor's Office suspected Danilo Mandić of attempted aggravated murder, claiming that he wounded Darko Perović and Aris Turković in the center of the capital on April 19. He is in custody, which was extended for another two months on May 22.
The Police Department claims that Mandić blocked the path of Perović and Turković with the official vehicle of the Parliament, a Range Rover jeep, and fired "several shots at them, which injured the injured parties in the leg area"... The official Range Rover vehicle is not on the list of the Parliament's vehicle fleet.
