The Court of Appeal of Montenegro announced today that on June 4, it issued a verdict confirming the verdict of the Higher Court in Podgorica of December 20, 2024 in the part in which the accused S.LJ. was sentenced to 15 years in prison for the extended criminal offense of sexual intercourse by abuse of position and the criminal offense of rape.
The statement added that the Higher State Prosecutor's Office (VDT) in Podgorica and the defendant's defense attorney filed appeals against this verdict.
"According to the assessment of the Court of Appeal of Montenegro, the appeals of the Supreme State Prosecutor's Office in Podgorica and the defendant's defense attorney are unfounded in challenging the first-instance verdict due to a significant violation of the provisions of criminal procedure, a violation of the Criminal Code, and the appeal of the defendant's defense attorney is also due to an incorrectly and incompletely determined factual situation, because this court believes that the challenged verdict does not contain significant violations of the provisions of criminal procedure and violations of the Criminal Code that are indicated in the submitted appeals, nor others that this court, as a second-instance court, is paying attention to ex officio," the statement states.
The Court of Appeal said that the court's verdict, Case No. 52/25, with more detailed reasons, will be published on the Court of Appeal's website.
