The review of the indictment filed by the Special State Prosecutor's Office (SDT) against Radoje Živković, Milan Vujotić and Dragan Knežević, for the criminal offenses of aggravated murder to the detriment of Damir Hodžić and creation of a criminal organization, was postponed today to November 12 at the Higher Court in Podgorica.
Lawyers Bogdan Lukić and Aleksa Stanković asked the presiding judge of the pre-trial chamber, Judge Vesna Kovačević, for a shorter period of seven days to try to contact their relatives or fellow defense attorneys, whom they replaced today by proxy. They need this period to inform the court whether the indictment review can be held without the presence of the defendants and without informing the defendants.
Lawyer Stanković said that he has no communication with the accused Živković.
"I have no contact with Radoje Živković and cannot give consent for the hearing to take place. I will try to get in touch with his family," Stanković said.
The judge stated that Živković is in custody in Turkey, while the defendant Knežević is in France. The defendant Vujotić was in custody, which he left and is now on the run.
"Turkey is not responding to the court's summons. Cooperation with Turkey has been poor for a year and a half," the judge said.
Attorney Lukić stated that he would talk to his colleague, attorney Draško Dapčević, about whether he would agree to the hearing being held in the absence of the accused Knežević.
In July last year, the Higher Court in Podgorica confirmed the indictment against defendant Radoje Zvicer, who is charged with the murder of Damir Hodžić and Adis Spahić in mid-October 2020 in Spuž.
The indictment stated that Zvicer ordered the kidnapping of Hodžić at the end of July 2020 because he believed that as one of the close associates of the previously murdered Alan Kožar, he knew where the latter hid money and drugs.
"Radoje Zvicer, as the organizer, between the end of July and the second half of August 2020, ordered the defendants Radoje Živković, Milan Vujotić, Dragan Knežević, Marko Miljković and Veljko Belivuk to find and, at a suitable opportunity, kidnap, and then in a treacherous manner, out of ruthless revenge, base motives - intolerance and hatred and in order to establish dominance, deprive the members of the opposing criminal organization, Milo Radulović and Damir Hodžić, of their lives," the indictment states.
On October 14, 2020, Hodžić was driven to Stanjevića Rupa near Spuž by his son-in-law Adis Spahić, who was killed that day.
In addition to Zvicer, Živković, Vujotić, Knežević, Miljković and Belivuk, there are also Marko Miljković, Ratko Živković, Nebojša Janković, Stevan Kraljević, Slobodan Kašćelan, Nenad Kaluđerović, Darko Prelević, Davor Perović, Blagoje Gašić, Dejan Gašić, Nikša Perović, Miloš Radonjić, Vladimir Vučković, Petar Đurović, Rade Garović, Mersudin Čolaković, Marko Kilibarda, Aleksandar Paunović, Nikola Spasojević, Radovan Mujović, Milan Knežević, Aleksandar Dragićević, Zoran Kažić, Aleksandar Ljumović, Borko and Bojan Bešović.
