When the craftsmen will enter the old government building to reconstruct the facility for the needs of the Special State Prosecutor's Office and the Special Police Department will be known when the appeal filed against the Decision on the Selection of the Most Favorable Bid is decided.
President of the Commission for the Implementation of the Public Procurement Procedure Milica Vukcevic she wrote a notice of termination of the public procurement procedure because an appeal was filed on November 17th.
"The submitted appeal suspends all further activities of the contracting authority until a decision is made on the appeal," Vukčević wrote.
The Ministry of Public Works recently selected a joint bid from the Nikšić-based companies "Ramel", "LD gradnja", "Stambeno" and Danilovgrad-based "Timing" for the adaptation of the old government building for the needs of SDT and SPO.
The tender was announced at the end of August, and with several extensions, it lasted until November 7th, when the decision was made.
"Ramel" and other companies have committed to completing the work on the building's adaptation within three months at the latest.
The company "Bemax" also applied for the tender, with subcontractors "Montinspekt", "Bauriss" and "Termosistem", but they were excluded due to an incorrectly completed declaration.
Although it was not stated in the notice, "Bemax" filed an appeal against the Decision on the Most Favorable Offer within the legal deadline.
That company submitted a bid in the amount of 1.781.788 euros, with “Montinspekt”, Bauriss and “Termosistemo” as subcontractors.
The bid was excluded because it was assessed that "Bemaks" incorrectly divided the part of the procurement subject matter that it was subcontracting to "Bauriss" (electrical engineering type of works, energy) and "Termosistem" (mechanical type of works).
The Commission considered that the company's statement was improperly drafted, which constitutes grounds for mandatory exclusion from the public procurement procedure.
"This is because the design of electrical works, energy, electronics and the design of mechanical works are not part of the subject of the procurement, but the subject of the procurement is the execution of works based on the prepared project," it says in the Decision on the selection of the most favorable bid.
Due to the inadequate premises in which the SDT and SPO operate, the first conclusion of the Government in July 2023 was to move these institutions to the old government building.
At that time, a donation was agreed with representatives of the project "European Union Support to the Rule of Law in Montenegro - Eurol III" and the US Embassy in Montenegro in the form of financing the preparation of a feasibility study for the old building, as well as the procurement of office furniture and IT equipment.
