The trial of the defendants Emil Tuzović, Stefan Đukić Mandić, Milan Brajović, Goran Milašinović, Stefan Janković, Ivan Čarapić and Milovan Sekulović began today at the Higher Court in Podgorica. During the second half of 2019, together with the late Damir Hodžić, they became members of a criminal organization organized in Montenegro by the late Mile Radulović and Alan Kožar.
In addition to this criminal offense, they are also charged with the aggravated murder of Serbian citizens Filip Marjanović and Vukašin Gošović.
Today, before a special panel presided over by Judge Simo Rašović, the defendant Milan Brajović gave a very detailed defense.
"I am not guilty. I do not feel guilty. I have never secured or rented a single facility for any purpose in the territory of Danilovgrad. None of the accused have stayed with me in the house in the village of Jelenak. I have never heard of Filip Marjanović and Vukašin Gošović. I have never used or had an encrypted phone," said Brajović.
He stressed that he would answer all questions from the court and all lawyers.
"In the first case I was charged with and for which I have already served three and a half years, there were messages: 'stay home, it will be easier when we get out of here'. These are the alleged messages between me and Stefan Đukić Mandić, and they were about me allegedly killing the chief special prosecutor Milivoj Katnić and Zoran Lazović. These same messages in this case mean: 'stay home, so that I don't leave the house so that someone doesn't kill me. If there weren't these messages, there wouldn't be this new indictment. Whether this is an evil intention of the special prosecution, I leave to this panel to assess. This material, these messages, have been listened to in the courtroom for six years, and it has appeared in the media, social networks, TikToks, and on the street," he said.
Brajović said that, due to someone's lies and fabrications, his life was made hell, and his family was made a horror.
"My family home, property and all my ancestral property have been desecrated. This is a crime against the Brajović family by the SDT. I ask this trial panel and all independent journalists to go to my house in the village of Jelenak and see for themselves. If there is a possibility that murders will occur, as stated in the indictment, I am signing a life sentence for myself. This is a house, a warehouse with bottles, crates... where my family enters about ten times a day. So wouldn't someone have noticed this many people, and I don't want to talk about the act of how the murder was allegedly committed and how it could be cleaned up without anyone noticing, which could be easily proven. There is a winery on the property and dozens of workers who picked grapes and made brandy during that period. It is clear to any sane person that this is impossible. In addition, the house is located in the very epicenter, which is surrounded by the houses of neighbors, relatives, uncles and cousins. Is it possible that no one "So many people noticed. It's also the period when juice is squeezed from various fruits. So is it possible that no one noticed this many people and no one saw anything," Brajović pointed out.
He added that they labeled his family and made them into monsters, and that "Mr. Prosecutor Vučinić is responsible for everything."
The report of the Forensic Center in Danilovgrad says that there is not a single trace, while the prosecutor writes that I had time to clean it up. Nothing has been done in that house for 40 years. Why is the SDT hiding secret surveillance measures, in order to hide their abuse, and my innocence. They eavesdropped on my entire family. And that was not enough for them, so they 'listened' to my 75-year-old father and bugged my house. The public in Montenegro read that person X asked person Y who to listen to, who to follow, who to arrest, and as if Milan Brajović was being framed for certain acts, and all of those measures were signed by Vladimir Novović. Despite all of the above, the SDT fulfilled the wishes of individuals, destroying the life of my family, in order to make statistics, and saving special prosecutors and people close to them, former and current prime ministers on Sky, former and current ministers, ambassadors, as well as judges of the Supreme Court, the Court of Appeal, for whom I am now submitting messages to the court. "Selective justice is worse than injustice," Brajović said today.
"When I said that because of someone's lies and fabrications, those people allegedly killed the injured parties, those people also wrote that they killed Alan Kožar's murderers, and they are all alive and well in the dock, and we read about that in the media," he said.
He added that these people wrote that they had killed Žuti Živković.
"...and he is alive and well in prison in Istanbul. These people said that they gave encrypted phones to politicians, that they bought elections for certain parties, and in real life I don't see that as true. From the list of missing persons that the SDT refers to is Lazar Ilić, there he is alive and well in prison in Spuž, then Dario Đorđević, known as Dexter, alive and well in prison in Austria, Marinko Brašnjević, alive and well in prison in Serbia. Honorable Chamber, there is information that the injured parties here were killed in Novi Pazar. Today I am not defending myself, today I am defending my entire family who found themselves in agony because of this false indictment," said Brajović in his defense.
Judge Simo Rašović noted that the accused Milan Brajović submitted a CD with messages to the court.
The defendants, Goran Milašinović and Milovan Sekulović, also denied the allegations in the SDT indictment.
The indictment states that the criminal organization aimed to commit criminal offenses in order to gain illegal power, with each member of the criminal organization having a predetermined task and role, both on an international scale and with the application of precisely defined rules of internal organization, and its actions planned for unlimited violence.
In the way that the late Mile Radulović and Alan Kožar recruited the defendants themselves or through other persons as members of the criminal organization, in order to commit murder and aggravated murder. Thus, the defendants Emil Tuzović, Stefan Đukić Mandić and the late Damir Hodžić had the task of acting on the orders of the late Mile Radulović and Alan Kožar as organizers, to, together with the late Alan Kožar and the defendant Milan Brajović, deprive the members of the opposing criminal organization of their lives, whom the late Mile Radulović and Alan Kožar had ordered to be killed out of ruthless revenge and to previously extort from them all information about the activities of the opposing criminal organization. By which the defendants Emil Tuzović, Stefan Đukić Mandić, Milan Brajović, Goran Milašinović, Ivan Čarapić and Milovan Sekulović committed the criminal offense of creating a criminal organization.
The late Mile Radulović and Alan Kožar, as organizers, in the second half of 2019, created a criminal plan to ruthlessly kill members of an opposing criminal organization, citizens of the Republic of Serbia Filip Marjanović and Vukašin Gošović, in a cruel manner, out of ruthless revenge, for whom the organizers had information that they had previously killed a member of their criminal organization, Zijad Nurković.
After the injured parties agreed to come from the Republic of Serbia on September 15, 2019 and enter Montenegro via border crossings, they hired the defendants Čarapić and Sekulović, who were nicknamed "Šljuka" and "Naočarko" in the criminal organization, to use a "Peugeot 207" vehicle provided for that purpose by the defendant Emil Tuzović, to wait for and accept the injured parties Filip Marjanović and Vukašin Gošović after their illegal entry into Montenegro, and then transport the injured parties and hand them over to the defendant Emil Tuzović, which the defendants Ivan Čarapić and Milovan Sekulović accepted.
By creating conditions and removing obstacles for the commission of a criminal offense, they intentionally assisted the defendant Emil Tuzović in the commission of the criminal offense of aggravated murder, and by aiding the defendant Goran Milašinović in the commission of the criminal offense of aggravated murder.
They transported and handed over to the defendant Emil Tuzović, who was waiting for them with a "BMW X4" vehicle, which had been lent to him for this purpose by the defendant Goran Milašinović, and on that occasion transferred the suitcases of the injured parties to the "BMW X4" vehicle.
After which, the defendant Emil Tuzović transported the injured parties to Spuže, where the defendants Milan Brajović and Stefan Đukić Mandić waited for them at an unspecified commercial building so that the defendant Brajović, as a local resident, could show them the way to the village of Jelenak, and then they transported the injured parties together to the house that the defendant Milan Brajović had provided in that village.
The indictment states that they forcibly extorted information from the injured parties Filip Marjanović and Vukašin Gošović that they were the direct perpetrators of the murder of a member of their criminal organization, Zijad Nurković, and attempted to kill Stefan Janković, known as "Krpa" and "Phantom".
After which, between 15 and 16 September 2019, in a cruel manner and out of ruthless revenge, and the defendants Emil Tuzović and Stefan Dukić Mandić and out of greed, they killed Filip Marjanović and Vukašin Gošović and inflicted several blows to the head and body with baseball bats. Tuzović, using the bayonet of an AK 47 automatic rifle, inflicted multiple stab wounds on the body, from which they died. Then they jointly hid the remains in a currently unknown location and removed traces and evidence of the crime committed.
What did the late Damir Hodžić inform the organizer of the criminal organization, the late Mile Radulović, about on September 16, 2019, via the encrypted communication application SKY ECC.
As a result, the defendants Emil Tuzović, Stefan Đukić Mandić and Milan Brajović, as co-perpetrators, committed the criminal offense of aggravated murder, and the defendants Goran Milašinović, Ivan Čarapić and Milovan Sekulović committed the criminal offense of aggravated murder by aiding and abetting.
