The Higher Court in Podgorica held a review of the indictment filed by the Higher State Prosecutor's Office in Podgorica against Nikola R. Petrović from Podgorica for the murder of Ivan Milačić on the terrace of a restaurant on Svetozara Markovića Street in the capital city today.

The special panel is chaired by Judge Zoran Radović, President of the Higher Court.

State Prosecutor at the Higher State Prosecutor's Office in Podgorica, Irena Burić, proposed that the indictment be confirmed.

"During the investigation, legally valid evidence was obtained, which indicates that the defendant Petrović committed the criminal offense of aggravated murder under Article 144, paragraph 3 of the Criminal Code of Montenegro and the criminal offense of illegal possession and carrying of weapons and explosives under Article 403, paragraph 3 in conjunction with paragraph 1 of the Criminal Code of Montenegro. I propose to the court to issue a decision confirming the indictment," said Prosecutor Burić.

Lawyer Aleksandra Rogošić, defense attorney for the defendant Petrović, proposed to the court to dismiss the indictment and discontinue the criminal proceedings.

"The defense believes that the legal qualification does not provide a sufficient degree of certainty to justify its confirmation. The indictment is unfounded, and therefore legally untenable. The decisive facts were established on the basis of legally invalid evidence that cannot be used in these proceedings. The defense emphasizes that at this stage of the proceedings there are open issues that do not allow its confirmation," emphasized attorney Rogošić.

The indictment states that on July 19, 2025, at around 11:50 p.m., on the terrace of the "Taormina" restaurant, on Svetozara Markovića Street, in Podgorica, Nikola Petrović intentionally killed Ivan Milačić and intentionally endangered the lives of the injured parties SR, KR, VJ, KM, I.Č, MA, MK and NL, by approaching the table on the terrace of the aforementioned restaurant, at which Milačić was sitting together with SR, VJ, KM, I.Č, MA and MK, and next to which NL was standing, while KR was walking along the sidewalk next to the aforementioned restaurant, and took out a pistol that he was carrying in a public place without authorization.

Then, according to the indictment, he fired several bullets from his pistol in the direction of Milačić, who on that occasion suffered life-threatening injuries from which he died. The injured party, KR, suffered a minor physical injury in the form of a gunshot wound to the left half of the lumbar region. The defendant then went on the run until July 22, 2025, when he was arrested in Sutomore.
