Correspondence between the suspended prosecutor Andrijane Nastic and one of the alleged heads of the Grand Clan Aleksandar Mijajlović shows that at the end of 2021, she reported in detail to her cousin about the relations, voting and mood within the Podgorica Basic State Prosecutor's Office (ODT), but also that the dismissal of her colleague - the prosecutor - had already been agreed upon at that time Nikola Boricic.
Boričić was dismissed from the position of Deputy Head of the Podgorica Prosecutor's Office by decision of the Supreme State Prosecutor's Office on December 24, 2021. This was done just a few hours after the prosecutors in the Podgorica ODT did not elect prosecutor Andrijana Nastic, who was suggested to them by the VDT as a proposal for the new Deputy Head of the Podgorica Prosecutor's Office.
A new deputy head of the ODT in Podgorica was then elected to replace Boričić. Armin Selmanović.
The messages, which, according to the files of the Special State Prosecutor's Office (SDT), were sent by Nastic, show that Boricic's dismissal was prepared in advance.
The evidence obtained by special prosecutors shows that she practically conveyed to Mijajlović in real time who voted for whom, who was calculating, and what the interests of individual colleagues were in the process of selecting the acting head of the Podgorica ODT.
This can be seen from the messages from December 23 and 24, 2021, when Mijajlović writes that Boričić "wants to convene a session here at the ODT in the morning" and that he is "wrong that I will not answer him whether I will be his competition", with the assessment: "Because he knows that no one will support him".
Special prosecutors allege that Mijajlović then advised her to "switch off", stating that he was afraid that he would get caught calling him:
"You just disconnect from everything and don't listen to him... Because I'm afraid my movie will fail and I'll call him," he wrote to her, and then that same day he used the term "harambaša" for Boričić, asking:
"Has the troublemaker calmed down?", while Nastic replies that he has called a meeting of the board and is "threatening the press tomorrow."
"Convoked the board this morning at 8:30... Threatens the press tomorrow," the prosecutor sent, after which Mijajlović also mentions the heads of the then Higher and Supreme State Prosecutor's Offices - Beautiful Medenica i Drazen Burić.
"Who the f*ck... Lepa and Dražen know about it," Mijajlović replied.
Special prosecutors quote messages from Prosecutor Nastić in their files:
“...Then the accused Andrijana Nastic sent messages with the following content: 'If it's not me, it'll be someone from Više... And everyone is scared, you know, their asses are in a hole... will this guy stay up there or not, so they don't know how to position themselves... they're waiting for the collegium in the morning' ... 'But they don't know that if they don't elect me, someone from Više will come, so they're weighing up with Boričić for sure... They have to declare by 11 am... And all the assholes... Lepin has to declare by 11 am... Well, let them... Let them resent her... And the colleagues have to declare on this Lepin proposal, if they don't agree, someone from Više will, you understand that Dražen did everything legally to remove this guy... Now, if he tries something, he'll surely struggle, that's a different story, but this is legally... Because he can't propose himself... Nor can his colleagues. Since you have a boss from Više who asks us to declare about me as deputy for 2022'. On December 24, 2021, the defendant Andrijana Nastić sent a message to the defendant Aleksandar Mijajlović: 'But there is nothing, it took 10, 9 voted', to which the defendant Aleksandar Mijajlović replied: 'Are you kidding??? And he stayed?', and the defendant Andrijana Nastić replied with a message containing: 'No, no.. From January 1, Armin from the Higher Prosecutor's Office is coming,'" the files state.
The following messages show that both then insult the prosecutors:
"Eh..em... What the hell are they... What kind of mice are they... Do you know who was there for you?", and defendant Andrijana Nastić to defendant Aleksandar Mijajlović: "And believe me, I didn't expect the kind of people here. Assholes... I know everything."
Responding to Mijajlović's question whether anyone surprised her, Nastic lashed out at her godmother: "The defendant Aleksandar Mijajlović sends a message: 'Did anyone surprise you?', and the defendant Andrijana Nastic replies with a message: 'Godmother first', and the defendant Aleksandar Mijajlović sends messages to the defendant Andrijana Nastic: 'Romina? That Vuksanović? ..... Are you kidding???????", and the defendant Andrijana Nastic sends messages: 'At five to 12 o'clock she voted for me... Romina voted for, Vuksanović abstained... Those are jealous assholes'... 'Women who are jealous didn't vote, it's too bad they didn't... There are various interests here... Vukas voted against... We've just heard each other... He won't vote like this... He's against Lepa', to which messages the defendant Aleksandar Mijajlović replies to the defendant Andrijana Nastic: 'That's Boričić's asshole', and the defendant Andrijana Nastic He responds to the accused Aleksandar Mijajlović with messages containing the following content: 'And he would be the first to sell Boričić. He only serves his goals', to which the accused Aleksandar Mijajlović sends the message: 'Of course'"....
ACCUSATIONS
According to the SDT, Mijajlović allegedly created a media network for years solely in order to deal with dissenters from the political and security leadership and the church, through loyal journalists and media platforms, but also to influence the political and security situation in the country.
The Special State Prosecutor's Office suspects that Mijajlović was directly assisted in this by the suspected high-ranking police and secret service officials. Drago Spicanovic, Milovan Pavićević i Vladan Lazović, as well as his cousin, prosecutor Andrijana Nastić, providing him with classified intelligence and information.
The organizer of the criminal group, as suspected by the SDT, received data obtained through secret surveillance measures, the content of numerous intercepted conversations, and allegedly had access to intelligence data and recordings from the National Security Agency (ANB) for years on a daily basis from the accused members.
SDT believes that from 2018 to 2024, Mijajlović directly created the editorial policy of numerous media outlets in the country: "Mportal", "Standard", "Pobjeda", "CDM", but also "Portal ETV", "Portal Analitika" and "Antena M", and he allegedly gave some of them instructions on how the texts should look and how long they should "stay on the front pages".
The SDT suspects Mijajlović of directly forwarding to the media information he received from the accused public and secret police officials and Prosecutor Nastic, in order to shape public opinion, create a negative media image, and discredit politicians, church dignitaries and numerous individuals and dissenters, as well as to undermine the security system.
SDT's evidence indicates that on several occasions Mijajlović sent data, photographs, shared topics, as well as suggestions for interlocutors for articles, and ordered Milovan Pavićević, while he was the chief of police in Podgorica, when and how to send police statements.
Judging by the extensive evidence of the SDT, the businessman was able to obtain personal information about citizens from the protected police system in a very short time, but he also had direct insight into what was being discussed regarding the enthronement of Metropolitan Joanikije in the parliamentary "deaf room", and he also received direct information from the Police Directorate's collegium.
The SDT suspects that the defendant Drago Spičanović, while he was the assistant director of the Police Department, Veselin Veljović, provided the head of an organized crime group with information about the participants and precise number of people gathered at the processions organized by the Serbian Orthodox Church in late 2019 and throughout 2020 due to the adoption of the Law on Freedom of Religion.
Data from secret surveillance measures was also sent by the defendant Vladan Lazović, while he was assigned to the Special Police Department as a police officer.
Secret information about who is under police surveillance or under secret surveillance measures was allegedly sent by the defendant Drago Spičanovišć on several occasions.
"They would live in the countryside if it weren't for Bemax"
The special prosecutors base their claims that Mijajlović's criminal organization also had influence in the judiciary on numerous messages he exchanged with the defendant prosecutor Nastic.
Prosecutors also highlighted messages that Nastic sent to Mijajlovic on November 30th:
"And I know all that and that's why I felt guilty... But do you understand that it's not pleasant to sit in the police station for 2 hours without any need, that's why I was angry, Boričić is still gloating, I'm angry at my godfather, at everything... Get off your bike, brother, they would live in the countryside if they didn't have Bemax, everything is on their list..."
Prosecutors claim that Nastic also informed Mijajlovic about numerous cases in the Podgorica State Prosecutor's Office, and after her promotion, about cases formed in the Higher State Prosecutor's Office in Podgorica.
The SDT suspects that she was tasked with delivering information in Mijajlović's criminal organization, and it is believed that she also sent data obtained through secret surveillance measures during the investigation of the attempted murder when Ranko Radulović's son was wounded.
She, as the SDT believes, revealed secret information that Radulović was shot by Stefan Koprivica, the son of former police official Duško Koprivica.
