The Special State Prosecutor's Office (SDT) today returned the temporarily seized mobile phone and two laptops to blogger and meme maker Aleksandar Klimović, known under the pseudonym Radosav Vrbica, six months after the legal deadline for their retention expired, the Human Rights Action (HRA) announced.

The non-governmental organization (NGO) recalled that the Special Police Department (SPO), on the orders of the SDT, confiscated the aforementioned items from Klimović on October 3, 2025, on suspicion that he had committed the criminal offenses of abuse of official position and disclosure of classified information, although, as the HRA points out, he had never held an official position.

According to a statement from the NGO, the legal deadline for retaining temporarily seized objects is three months, unless criminal proceedings have been initiated in the meantime.

"As no proceedings were initiated in this case, that deadline expired on January 3, 2026," the statement added.

HRA states that lawyer Dalibor Tomović, whom the NGO hired to represent Klimović, has repeatedly sent letters to the SPO, requesting information about the cases and their return.

"After that, he submitted a proposal to initiate proceedings before the Center for Alternative Dispute Resolution, as well as a lawsuit to the Basic Court in Podgorica against the state of Montenegro, due to the illegal retention of the seized items. The Center for Alternative Dispute Resolution has in the meantime submitted a notification that the state did not accept the mediation procedure within the stipulated deadline," the statement said.

The HRA assessed that the temporary seizure of personal belongings that lasts longer than the legally prescribed period, without explanation and without initiating criminal proceedings, constitutes a violation of the right to property and the right to fair treatment.
