At the proposal of the Special State Prosecutor's Office, temporary blockades of valuable real estate in Montenegro continue - the Higher Court in Podgorica issued a security measure as part of the financial investigation launched against Darek i Vukasin Hrnjeza i Igor Seferovic, accused of money laundering.
The SDT deed in that case was registered on a dozen valuable apartments and garages on the coast, an orchard and plots of land, as well as on property registered to the closest family members of the defendants in Žabljak.
Investigative Judge of the Higher Court in Podgorica Goran Scepanovic On August 4, the court issued a temporary measure, at the proposal of the SDT, on a family building with three apartments with a total area of almost 200 square meters in Lepetani, as well as on an orchard of 2.254 m2 and a plot of 814 square meters in Lastva, which are registered in the Nevena Hrnjez.
During the financial investigation process, which was initiated in parallel with the criminal proceedings against Igor Seferović, the court issued a temporary measure prohibiting the disposal of several apartments and garages in two buildings in Tivat.
The SDT deed is registered for nine apartments of 50-60 square meters each, three garages in a building in Tivat, as well as a 177 m2 yard, where Igor Seferović, who is suspected of money laundering, is registered as the 100% owner.
A temporary blockade has also been registered for another building that is registered in the Tivat Municipality Real Estate Register under the name of the defendant Seferović - the measure was registered for two apartments of 55 m2 each, as well as for two garages with land next to the building with an area of 186 square meters.
The High Court also accepted the proposal of the Special State Prosecutor's Office to register the temporary measure on the property as well. Slavica Seferovic in Žabljak, where a large number of plots and pastures have been registered.
Based on the Law on the Confiscation of Proceeds of Crime, two cars were temporarily seized from the defendant Seferović - an "Audi A4" and a "Nissan X-Trail 1.6 dci", while a "Golf 8" and 4.300 euros in cash were temporarily seized from Nevena Hrnjez.
An appeal may be filed against the court's decision on a temporary measure, and defendants are required to submit evidence of the origin of the property gain for which a temporary security measure has been ordered.
The temporary measure may last no longer than until the decision on the permanent confiscation of property gained through criminal activity becomes final, and it will be revoked ex officio if it does not enter into legal force within two years from the date of issuing the indictment.
The investigating judge rejected the SDT's proposal to impose a temporary measure prohibiting the disposal of real estate on the property of the company "CAPITAL HILL", where the company, registered under the name of Nevena Hrnjez, has a business space of 588m2, as well as about ten apartments in the Sutvara neighborhood in Tivat.
At least 1,4 million square meters of land or forests, slightly more than 300 residential, business and non-residential units or buildings, and over 30 cars were blocked in the first half of the year based on decisions of the Podgorica High Court, and within the framework of investigations and proposals of the Special State Prosecutor's Office.
Deed and letter of request from Antwerp
Investigative judge Goran Šćepanović, upon a request from the Court of First Instance in Antwerp, issued a temporary measure to freeze property in Budva registered to Macedonian Suat Vusljanin and Serbian citizen Miroslav Bojović, against whom criminal proceedings are being conducted in Belgium on charges of drug smuggling and money laundering.
The Special State Prosecutor's Office, upon a request from the Court of Antwerp, submitted to the court on August 3 a proposal to register a temporary measure for several apartments in Budva, which are registered in the names of the defendants Vusljanin and Bojović.
The court entered a measure against Vusljanin on an 80 square meter apartment and a garage in Budva, while a temporary measure was also accepted for Bojović, who has a 96 square meter apartment in Budva and two garages in his name.
Bojović's 927 m2 forest in Tudorovići, Kotor, has also been temporarily blocked because there is a reasonable suspicion that he acquired the property through criminal activity.
