"I'll slaughter you in your sleep, I have four children alive, I kissed them dead at home, like this MV who slaughtered these, you won't know what hit you, I swear on my four children I'll kill you, I'll slaughter you, you're too small to stop me..."
According to court documents, this was stated by Rožajac J. Kalač, speaking to a police officer during a traffic control on the night between April 26 and 27.
The details are contained in the decision of the Higher Court in Bijelo Polje of May 6, 2026, which rejected the appeal of the defense attorney suspected of committing a criminal offense - assault on an official in the performance of official duty, and then confirmed the decision of the investigating judge of the Basic Court in Rožaje ordering detention for up to 30 days.
"I know you have a child, you will see your child, I will slaughter you in your sleep," the suspect said, according to a court document.
According to the Official Note of the Rožaje Security Department dated April 27, 2026, police officers NA, HI and MF were performing regular duties on the M-5 Rožaje - Berane highway.
At around 00:45 in the town of Rasadnik, near the "Wahels" hotel, they stopped a "Passat" passenger car driven by Kalač.
The file, which the judges cite, states that Kalač was visibly intoxicated and that he refused the officer's request to submit to a breathalyzer test.
After that, he made the above threats to the NA officer.
"Just go, I swear on my four children I will slaughter you in your sleep, just go, you are mine and God's, you will see, you will remember me when you take off your uniform, you will pay me later, I wait for you every night, I know you have a child, you will see your child too, I will slaughter you in your sleep," the ruling of the Bijelo Polje High Court states.
It is explained that the suspect refused warnings and orders to stop making threats and go to the police station.
However, after reinforcements arrived at the scene, he was brought to the premises of the Rožaje Security Department.
He pleaded not guilty
At the hearing before the Basic State Prosecutor's Office in Rožaje on April 28, the suspect, it is written, denied committing the criminal offense of assault on an official in the performance of official duty.
He stated that he was under the influence of alcohol, that he had nothing against NA, that he was remorseful, and that he was ready to apologize and reconcile with the police officers.
Before the investigating judge on April 29, he maintained his statement, adding that he had been convicted several times before (including for forest theft), and that proceedings were being conducted against him before the Basic Court in Berane due to an argument with an officer from the same police station.
"In the record before the Basic State Prosecutor's Office in Rožaje.... the suspect essentially denied committing the criminal offense, and added that he was under the influence of alcohol on the critical occasion, that he had nothing against NA, that he regretted everything that happened, and that he was ready to apologize to the police officers and reconcile with them. In the record before the investigating judge of the Basic Court in Rožaje Kri.br. 77/26 of 29. 4. 2026, in essence, he maintained the allegations made before the competent prosecutor's office, but he pointed out that he had been convicted several times before, once for forest theft, and the proceedings due to an argument with an officer of the Rožaje Police Station are ongoing before the Basic Court in Berane," the court document states.
The Trial Panel reasons that the aforementioned evidence, taken together, gives rise to a reasonable suspicion that the suspect committed the criminal offense.
"A reasonable suspicion is a prerequisite for ordering detention of a person (the substantive legal basis for detention), while the fact of whether the defendant actually committed a criminal offense will be determined in the further course of the proceedings, if an indictment is issued."
It is clarified that, according to the court's ruling, and contrary to the appellate allegations of the suspect's defense counsel, the investigating judge of the Basic Court in Rožaje acted correctly when he ordered his detention....
"Namely, the suspect KJ is reasonably suspected of having committed the criminal offense in question, and when the aforementioned fact is correlated with the facts that on the critical occasion he made serious, realistic and achievable threats to the police officer AN, threatening both the life and body of the injured party and the life and body of a person close to him - the child of the injured party, and with the fact that the same is a returnee in the commission of various criminal offenses, including a criminal offense with elements of violence, and that he himself pointed out that proceedings are being conducted against him before the Basic Court in Berane due to an argument with an officer of the Rožaje Police Station, the aforementioned facts and circumstances in their entirety represent special circumstances indicating that the suspect will commit the criminal offense he is threatening, i.e. according to them, the reasons for detention prescribed in Article 448, paragraph 1, item 2 of the Criminal Procedure Code are met."
They issued the named person several warnings, then ordered him to stop making threats and to come with them to the station, which he refused, so they called for reinforcements, after which they managed to bring him to the Rožaje Security Department.
Sentences from six months to five years in prison
Anyone found to have attacked an official in connection with the performance of public or national security duties will be punished with imprisonment from six months to five years.
This is stated in the Criminal Code of Montenegro.
"Whoever attacks or threatens to attack an official in the performance of his official duty shall be punished by imprisonment for a term of up to three years... If the act... is committed against a judge or state prosecutor in connection with the performance of their judicial or prosecutorial duties or against an official in connection with the performance of public or national security duties, the perpetrator shall be punished by imprisonment for a term of six months to five years," reads Article 376 of the Criminal Code.
