Land owners in Đenovići, Russian citizens Nataliya Sidorova and Sergey Kočergin, called on representatives of the company Azmont Investments to provide legally valid evidence that they have the authority to usurp their property and carry out construction work on it.
"Representatives of Azmont Investments, which is building the luxury complex Portonovi in Kumbor, usurped our property, entered our property and are carrying out large-scale construction works there, which violates our basic civil rights, as well as the Constitution and laws of Montenegro," stated Sidorova and Kochergin in the statement.
Last week, they announced legal proceedings against Azmont Investments for carrying out construction work on their property. Sidorova and Kochergin added that in Montenegro and in front of international authorities, they will use all legally permitted means to protect their private property and civil integrity.
"In civilized and democratic countries, private property is sacred, and we acquired ownership of our immovable property in Montenegro more than eight years ago, by purchasing it from locals from Đenovići, Marija Mustur, Jasna Čanja, Miroslav Cerović and Branka Krivokapić. For each square meter, we honestly paid the purchase price, as well as all the necessary taxes," said Sidorova and Kochergin.
They also said that their dream of a house on the seashore turned into a nightmare, because there are heavy construction machines on their property, in front of the still unfinished house.
"The state institutions and inspections, to which we turned, not only did not protect us, but openly sided with the usurpers," announced Sidorova and Kochergin.
They stated that through their legal representative, lawyer Milija Mijanović, they informed the public about the actions of Azmont Investments and submitted indisputable evidence, after which the representatives of the investors accused them of trying to obtain material benefits.
"Instead of acting in accordance with the laws of Montenegro and being an example of good practice of relations with citizens - neighbors during the implementation of a large investment, they reduce the level of communication to shallow and unfounded accusations against us and glorification of their role as investors, which no one disputes anyway" , said Sidorova and Kochergin.
They claim that the construction inspection, which went to the field at the request of Mijanović, could not dispute the ownership of the land, but assessed that the investor is carrying out works in the sea, next to the plots of Sidorova and Kochergina, as well as that he has the Government's conclusion giving consent for carrying out large-scale preparatory works for the construction of buildings of general interest as part of the State study of the location of Sector 5 - Kumbor.
"That was enough for them to refer to the Law on Spatial Planning and Building Construction, according to which such works can be carried out based on the consent of the Government," said Sidorova and Kochergin.
They claim that the law clearly defines that for such works the investor must also submit proof of the right of ownership, that is, some other right on the construction land in the sense of certain elaborations.
"As for the statement that the works are being carried out in the sea, it would be clear to a layman that this is not true. We invite all those interested to come to Đenovići and see for themselves where the works are being carried out and what the investor has done with our property," said the announcement of Sidorova and Kočergin.
Sidorova and Kočergin are asking the competent Real Estate Administration in Herceg Novi to provide them with legally valid evidence, i.e. the basis for the "disappearance" of part of their plot from the cadastral records, namely the one on which work is being carried out.
"Namely, at the end of January, we obtained a copy of the plan of the plots in question from the competent Real Estate Administration, which is different from the copy of the plan that we took out in June 2009. The difference is that on the new copy there is no part of the cadastral plot on which works are now being carried out," Russian citizens claim.
They asked the relevant Montenegrin institutions, administration, foreign embassies and missions whether Montenegro is a legal state and whether private property is protected by law.
"Can anyone, even a foreign investor, usurp and destroy citizens' private property in this way? "Are the state and its institutions at the service of investors, to the detriment of real estate owners," asked Sidorova and Kochergin.
They also asked the question whether any citizen of Montenegro, owner of real estate or land, can feel safe when he sees how, despite numerous indisputable proofs of ownership, the rights of property owners are being brutally violated.
"Are there private interests behind such a brutal violation of human rights, laws and the Constitution of Montenegro," asked Sidorova and Kochergin.
