The Azerbaijani company Azmont Investments, which is building an exclusive tourist complex in the former military barracks in Kumobur, usurped the private land of Russian citizens Natalia Sidorova and her brother Sergey Kochergin and has been carrying out construction work on it for five months.
This was said today at a press conference by lawyer Milija Mijanović, who on behalf of Russian citizens announced that the issue would be raised with the competent judicial authorities.
Mijanović presented complete documentation showing that two Russian citizens are in the Real Estate Administration (KO Herceg Hovi) on 23.06. in 2009 were registered as the owners of their plots, and that on 27.01.2016. years, they do not act as the owners of the part of the plot on which Azmont investments is carrying out works.
"It is not clear on what basis and in what manner the physical change of the land was carried out by the competent authority, without the owner's consent. This certainly represents incredible data for concern and fear," said Mijanović.
He said that Azmont Investments ignores the appeals of Russian citizens, and that the construction inspection that was on the ground informed them that the investor "has the Government's Conclusion that gave him permission to carry out large-scale preparatory works for the construction of buildings of general interest."
"The goal of my clients is not to prevent or in any way hinder the construction of the large tourist resort Portonovi, which is of national interest and a major investment for Montenegro. can, without any consent of the owner, physically enter someone else's property with huge machinery, occupy it, physically destroy part of the plots and close the access to the coastal zone," Mijanović pointed out.
He added that no one disputes that the land in question has been registered with the Real Estate Administration, according to which it is located in the marine property zone.
"But in a situation like this, the question arises whether this means that the registered right of ownership of that type of load has absolutely no meaning. Does this mean that it not only does not produce legal effect towards the state, but also towards certain third parties, who are apparently for some reason privileged to such an extent that the fact that somewhere there is someone who is registered as the owner of the land means nothing to them," Mijanović pointed out.
Azerbaijanis doubt that material benefits will be obtained
The Azerbaijani company Azmont investments told "Vijesta" that they do not carry out any construction work on private land, but only on the land and in the water area that are the subject of the long-term lease contract for the "Orjenski Battalion" barracks site signed with the Government.
They said that all construction works are being carried out within the scope of the State Site Study (DSL) Kumbor Sector 5, and in everything in accordance with the Government's conclusion. They explain that this conclusion approves large-scale preparatory works for the construction of buildings of general interest and a construction permit.
"In addition to those documents, we have several studies, reports and permits necessary for Portonovi to come to life as a project of national importance," they said in Azmont.
They add that all available documents, plans and project documentation are proof that neither now nor in the future will there be any construction outside the boundaries clearly defined by the contract on the long-term lease of that location.
Azmonts said that representatives of the company Rare Developments (who represent them when it comes to the development and construction of the Portonovi project) met with representatives of Sidarova and had several phone conversations in November last year.
"Azmont representatives met with them in December of the same year, all in order to continue regular and transparent communication. We believe that the actions of representative Sidorov have no legal foundation. We suspect that it is about a certain type of pressure with the aim of obtaining material profit", they said in Azmont.
They reminded that Portonovi will have the most modern marina and will be the first "one and only" resort in Europe that will be supplemented with the "Espace Chenot Health Wellness Spa" center and the Yachting Club designed by the Winch Design studio.
"All this means that its construction will not cause damage to the environment and the surrounding plots, but that the plot owners themselves will benefit. So also Sidarov or her brother" they said in Azmont.
