The state commission established that Montefarm made a decision to award the work to the Dubai company in batches, even though it did not have proof that it was registered to perform the activity that is the subject of the procurement.

Namely, the Dubai company submitted only proof from the Central Register of Business Entities that its activity code is non-specialized wholesale trade.

The same omission was made by the company Farmont from Podgorica, while the company Urion submitted to the client an extract from the Central Register in which it stated that the company's activity code is engineering activities and technical consulting.

"Given the factual situation established in this way, and bearing in mind that the subject of this public procurement is the procurement of medicines and medical devices, the commission finds that the contracting authority, when evaluating the correctness of the Dubai, Farmont and Urion bids, incorrectly and incompletely determined the factual situation regarding the mandatory condition that the bidders must be registered for the subject of public procurement. It is unclear in what way and on the basis of which evidence he concluded that the offers of these bidders, in relation to the stated condition, are correct", he writes, among other things, in the decision of the Commission, which was signed by its president Suzana Pribilović.

Ex officio, the state commission overturned Montefarm's decision to award the jobs in batches to the companies Vilab Pharm ltd from Cyprus, Medikom Šabac, Pharmaswiss Belgrade, SanMed Gmbh from Austria and Monterusfarm from Podgorica.

It was pointed out to Montefarma that in the public procurement procedure he committed significant violations of the Law on Public Procurement, as well as a significant violation of the rules of administrative procedure. That institution was ordered to eliminate irregularities within 15 days, reevaluate the offers and make a legal decision. Those dissatisfied with the decision of the Commission can appeal to the Administrative Court within 30 days.

The total value of Montefarm's annual procurement was about 28 million euros, and 164 lots or about 15 percent of the total procurement value were returned to the re-evaluation and evaluation procedure.
