The start of the trial on the private lawsuit of MANS executive director Vanja Ćalović, against the former member of the Management Board of Željezara AD Nikšić Danijelo Brol, accused of giving a false statement, was postponed, because the defendant did not appear at the trial.
The court could not find Brol at his last known reported residence in Nikšić.
Although Ćalović and her lawyer Veselin Radulović insisted that Brol be looked for at an address in London, judge Maja Zeković believed that the Police Administration should first be asked for information on whether he has another registered residence or address in Montenegro.
"We think that it is unnecessary, Željezara got a new management in the meantime, so he is certainly not in Montenegro", stated Radulović.
"Lost Trust"
Ćalović accuses Brol that, in the criminal proceedings in which she was acquitted of defamation, following a private lawsuit by MNSS BV from Amsterdam and Željezara from Nikšić, in the capacity of a witness, he gave a false statement with the intention of causing her harm and causing a conviction.
"Brol claimed that off shore companies are overseas companies and that the daughter company of Željezara Nikšić in Amsterdam is not an off shore company, that Željezara from Nikšić paid all taxes and contributions for 2009 when they are due, that due to Ćalović's statement the installation of equipment at Željezara is delayed and that the development of the company is not as expected, because the people with whom the company did business have lost confidence in the company," the indictment states, among other things.
In the abundance of evidence in the indictment, it is added that the defendant graduated from the Faculty of Economics and postgraduate studies in accounting and finance, that he was one of the directors of the Nikšić Ironworks who participated in making the decision to establish a subsidiary company in Amsterdam.
"Thus it is indisputably established that the defendant knew that offshore companies are companies that provide foreigners with the opportunity to establish a company with the payment of minimal taxes, and in some cases even without the obligation to pay taxes, that he knew that the daughter company in Amsterdam was an offshore company and that consciously kept his knowledge silent", it says, among other things, in the explanation of the indictment.
Application also against the prosecutor
Radulović also filed a criminal complaint against the deputy primary state prosecutor, Zoran Vučinić, who believed that there were no grounds for prosecuting Brol, ex officio, for giving a false statement.
"The statements of the deputy of the ODT that the defendant presented his evaluations of the public presentations of Ćalović related to her doubts about the legality of the operations of Željezara Nikšić are illegal, incomprehensible and false, and as such cannot be considered as giving a false statement in the criminal-legal sense," he writes. in the indictment.
