The dilemmas surrounding the publication of information about the submarine cable with Italy were in the center of attention in the announcement of the Network for the Affirmation of the Non-Governmental Sector (MANS) and the Ministry of Economy.
MANS announced that the ruling of the Administrative Court regarding the publication of information is binding on the Ministry of Economy, and that its non-execution cannot be justified by the fact that the consent of the Italian partner was not obtained, while the government department stated that they did not refuse the request for access to information about therefore, "it only stopped the procedure until obtaining consent" from the Montenegrin electric transmission system and the Italian Terna.
MANS reminds the Minister of Economy, Vladimir Kavarić, that he does not need the consent of "a private company to enforce the laws of Montenegro, and especially to enforce the judgment of the Administrative Court".
"In addition to the fact that this is his obligation as a holder of public office, we remind Kavarić that the publication of data on energy projects is also a recommendation of the European Parliament," reads the MANS announcement.
According to the claims of MANS, the Ministry would have to explain to the citizens what the agreement with Terna assumed as an obligation, what rights were given to the Italian company and how the public interest was protected in this business.
"This is all the sooner because the entry of Terna into Montenegro, the recapitalization of the Montenegrin Electric Transmission System (CGES) and the signing of a whole series of documents between Montenegro and Italy were done far from the eyes of the Montenegrin public, so now we can only guess what the Government has taken upon itself, that is, on the citizens", state the representatives of MANS.
The Ministry, however, announced that "the Italian partners claim that the requested contracts contain industrial and commercially sensitive information and business secrets, as well as that the publication of the contracts would significantly threaten their interests."
"That the state is determined to publish the contract is also confirmed by the fact that Crnogorski elektroprenosni sistem AD, as a majority state-owned company, gave its consent to the publication of the contract on March 04, 2011. Another confirmation of the commitment of the Ministry of Economy to the principle of transparency is the fact that The Ministry of Economy published on its website the Law on Confirmation of the Agreement between Montenegro and the Republic of Italy on the construction of the submarine electric power interconnection between the transmission networks of Montenegro and Italy with the implementation of the strategic partnership of the transmission system operators, which was adopted by the Parliament of Montenegro, and the European Parliament was informed about it. , it is stated in the statement of the Ministry and adds that "it will certainly respect the decision of the Administrative Court, which, in this particular case, ordered the Ministry of Economy to decide on the request and not to publish the contracts".
"In order to disclose the contracts, we will continue to insist on obtaining consent from Terna so that they can be published without adverse consequences," the Ministry of Economy announced.
