The Commission for the Control of the Public Procurement Procedure partially adopted the appeal of the company "Briv Construction" from Kotor and annulled several parts of the tender documentation and provisions of the draft contract of the Traffic Administration, in connection with the construction of the road Cetinje - Čevo - Nikšić, section Cetinje - Čevo, length about 23 kilometers, the estimated value of which is 37 million euros.

The State Commission ordered the Traffic Administration, headed by director Savo Parača, to eliminate irregularities within 15 days. The Commission will return 20.000 euros in appeal fees to the company "Briv Construction", and the Traffic Administration should pay the company 400 euros for the costs of drawing up the appeal.

The Traffic Administration announced the repeated tender on November 1 this year, and then made three changes to the tender documentation and seven clarifications.

The draft contract, however, is not in accordance with point XV of the call for public tenders, nor has the Administration, by any other provision, foreseen the contractor's obligation to submit a detailed dynamic plan for the execution of the works. The state commission determined that the term and method of payment for temporary situations had not been agreed upon. It was also established that there were several inaccuracies that could lead to discrimination of bidders.

In October, the Commission for Control of the Public Procurement Procedure canceled the first tender of the Transport Administration for this road. At that tender, the offer of the company "Briv Construction", which offered to build the road for 34,43 million euros, was also chosen.

The offer of the company "Bemax" from Podgorica was ranked second with a price of 36,87 million euros. "Mechanization and programming" came in third with 36,89 million euros, while the offer of the Tivat company "Sampetrol" was rejected as incorrect.
