The Commission for the Protection of Rights in Public Procurement Procedures, ex officio, canceled the tender of the Public Works Administration (UJR) in connection with the construction of a substation in Zlatica with integration into the high-voltage infrastructure, for the needs of the PTJ and Special Police Unit (PJP) accommodation facilities complex, which building in Podgorica.
At the tender with an estimated value of 135.000 euros, announced on December 4 last year, the offer of the company Eminent was chosen as the most favorable, while the offers of the companies Eurozox - Danilvgrad, Ramel - Nikšić and the Energy Union "Vis Solis Montenegro" from Podgorica were rejected as incorrect.
The energy community "Vis Solis Montenegro", which complained about the tender to the Commission, will be reimbursed the fee for conducting the appeal procedure in the amount of 1.350 euros, while the person ordering the disputed procurement UJR will have to return 400 euros, within 15 days, after the finality of this solutions.
The commission found that the procurement authority did not clearly and comprehensibly describe the subject of the procurement in the tender documentation and set the requirements regarding its execution, which were important for the preparation of the offer and the execution of the contract.
Furthermore, from the factual situation in the documentation, the Commission determined that there are certain differences in the technical characteristics of the reinforced concrete housing, power transformers and medium voltage distribution, which were required by the preliminary measurements of the works from the tender documentation, compared to the characteristics "that were foreseen by the preliminary measurements of the works contained in the main the project, according to which the works were to be carried out".
