The account of the Public Institution "Grad Teatar" has been blocked since yesterday in the amount of 24.232,85 euros, due to the execution of the final judgment of the High Court in Podgorica in favor of the company "Copyrigt".
The company of businessman Marko Kentera is forcibly collecting the debt it took over from the Budva company "Patent".
In 2013, the company "Patent" performed the work of technical implementation of the "Grad Teatar" festival. The contract specified that the technical implementation of the program costs 23.400 euros, and on June 30, 2013, "Patent" submitted an invoice to the then management of "Grad Teatra".
Since "Grad Teatar" did not pay off the debt, "Copyright" concluded an agreement with "Patent" on the assumption of claims in November 2014 and began collecting the debt.
JU "Grad Teatar" gave its consent to take over the debt.
Since "Grad Teatar" still did not pay this obligation, a court case was initiated in 2016, which ultimately resulted in a High Court ruling obliging "Grad Teatar" to settle the debt.
The judgment, however, refers only to the principal in the amount of 23.400 euros, while the amount of interest was returned to the Basic Court of Kotor for retrial.
The blocking of the account comes at a time when the Public Institution started paying the November salaries and did not do so in full.
It is now expected from the Municipality, which is the founder of "City Theater" to transfer the money to the account of the Public Institution and unblock it in accordance with the budget obligations.
This year, that public institution did not even spend as much money as was foreseen by the reduced rebalancing.
Another municipal organization - the Tourist Organization of Budva is threatened with forced collection by "Copyright" if the latest judgment of the Commercial Court becomes final.
The tourist organization of Budva, which "Vijesti" recently wrote about, will have to pay 530 euros to the Budva company "Copyright", because it violated copyright and organized cultural events without first obtaining permission from that company, whose works are copyrights. .
This is the verdict of the Commercial Court in Podgorica, in a retrial, which is practically identical to the one from June last year, which was overturned by the Appellate Court after an appeal by the Budva TO author's works.
As "Vijesti" was told, TO Budve will appeal again to the Appellate Court against the re-verdict of the Commercial Court.
"It is established that the Tourist Organization of Budva violated the copyright of the Society for the Development of Tourism and, Protection of Copyrights and Provision of Services DOO Budva, in such a way that without its permission and payment of royalties it used - publicly organized works of authorship - cultural manifestations" Days of Budva artists', 'World music stage fest', 'Kadm's Day', 'Theatrical wave', 'Brodet fest', 'Summer music' and 'Pašticada fest', writes in the judgment of the judge of the Commercial Court Senada Hasanagić.
The judgment obliges TO Budva to pay "Copyright" the amount of 538.109 euros with statutory default interest starting from 27 November 2017 until payment.
