The changes to the decision were published in the Official Gazette, while there was no official announcement by the Government regarding the breaking of the deadline for the preparation of one of the most important state documents. In the explanation of the change in the decision, which "Vijesti" has access to, it is explained that in the process of developing this plan, it is necessary to carry out an audit by a special Council appointed by the Government. The revision included the concept and draft of the planning document and the report from the public hearing.
"However, due to unforeseen circumstances affecting the appointment of the Review Council, it was not possible to review the concept of the spatial plan within the planned period", explained the department headed by the minister Ratko Mitrović.
In the explanation, it was stated that the Ministry of Spatial Planning asked the Agency for the Prevention of Corruption (ASK) for an opinion on whether interested candidates who want to be on the Audit Council have the status of public officials in accordance with the Law on Prevention of Corruption and whether they must behave accordingly by law, and that the ASK's position is that they have the status of a public official.
"The Ministry informed the appointed members of the Council about the opinion of the Agency, after which the president and a significant number of members, not counting the representatives of the municipalities, informed that they are giving up their membership in the Council, because they do not like the status of a public official, which implies certain obligations and limitations. This state of affairs affects the dynamics of the preparation of this planning document and its adoption, so it is not possible to meet the deadline defined by the law until March 7 of this year. That is why we propose to change the decision and extend the deadline for the preparation until December 31, 2022", the ministry stated in the explanation.

This was announced by Mitrović and the state secretary in that ministry Radovan Bojović at the control hearing at the Committee for Tourism, Agriculture, Ecology and Spatial Planning on the topic "Situation in the field of spatial planning in Montenegro" in July of last year.
The creation of the State Spatial Plan and the General Regulation Plan was started by the former government and designated the bearers for those projects, but the new management of the ministry, after conducting an analysis, determined that the contractual obligations were not being respected, so it terminated the contracts with Jovanović and with Ksenija Vukmanović which was the carrier for the development of the General Regulation Plan.
After that hearing, the Committee for Tourism, Agriculture, Ecology and Spatial Planning made seven conclusions, the first of which was that the Government should submit the new Spatial Plan of Montenegro to the Parliament by April of this year at the latest.
In one of the conclusions, the Government is invited to intensify activities on the development of regulations in the field of spatial planning and construction of facilities, to pass a new law on spatial planning and construction of facilities from the end of February 2022.
"The board believes that the existing law should be divided into several laws and a law on the regulation of professions should be passed in order to define what profession can do in accordance with professional education. The existing law of the rebbe should be divided into laws on spatial planning, on the construction of buildings, on the legalization of illegally built buildings, and architectural and engineering works in spatial planning.
