The public company National Parks of Montenegro did not submit to the Revenue and Customs Administration (UPC) the profit tax application and the financial report on operations for the previous year in the extended deadline until May 31 of this year.
This was officially told to "News" in the UPC, while the National Parks state that the reason for not submitting the report is that the new management that took over the management of the company at the end of last year noticed irregularities in the business, so it was not able to submit the final report within the legal deadline. account.
The company did not clearly answer the question of "Vijesti" when they will submit the report and whether they have preliminary data on how they did business last year.
The legal deadline for submitting last year's report was March 31 this year.
The government of the recent prime minister Zdravka Krivokapića she appointed a physical education teacher at the end of December Aleksandar Bulatović for the director of National Parks, after the previous one was dismissed from that position lawyer Jelena Kljajević (DF). In July of last year, Krivokapić was dismissed from the position of president of the Management Board of this company Marina Jocic (DF).
The Democratic People's Party (DNP), of which Kljajević is a member, announced in December that "the Montenegrin public must know that Jelena Kljajević was removed from the position of director only because Zdravko Krivokapić is the uncle of Aleksandar Bulatović, who was appointed as the new director."
Application without signature
Data obtained by "Vijesti" from sources in the National Parks show that the company ended last year with a positive result of 523.301 euros in net profit, while subsequent corrections increased that result to 598.871 euros.
"In the year marked by the corona crisis in 2020, the company was unable to work, so the original income from the tourist season was missing. "The support from the budget was insufficient for normal functioning, so that during the payment of wages, taxes and contributions remained unpaid for most of 2020 and part of 2021," says the source of "Vijesti".
The UPC stated that on June 1, the National Parks submitted a financial report and a profit tax return to the archive in written form that was not signed by an authorized and responsible person and not stamped with the seal of a legal entity, as well as that the documentation was accompanied by an explanation as to why they did not act. according to the decision of the Administration to submit the documentation by May 31.
The UPC explained that in that explanation, the management stated that upon assuming office at the end of last year, it inherited a series of irregularities from the previous administration, which is why they could not meet the deadlines for submitting reports and that they are not in a position to sign and guarantee the truthfulness and accuracy of financial statements before a detailed analysis and audit of financial operations is done.
"Given that the taxpayer submitted an uncertified and unsigned income tax return and financial statements for the year 2021, physically in the archive, and not electronically from the perspective of legal regulations and procedures, he is considered a non-filer", the UPC explained, adding that he will initiate an inspection if he deems it necessary, but only after the company submits a certified and signed financial report with a tax return.
Observed irregularities
The National Parks claim that one of the irregularities is that at the end of December 2021, the account was threatened to be blocked due to unpaid taxes and contributions of about 800.000 euros, so repayment in installments was agreed with the UPC, and later a rescheduling, and that as of today, about 270.000 euros of debt with regular settlement of due taxes and contributions for 2022.
"A significant problem in the preparation of financial reports was the operation of the restaurant "Jezero" on Lake Skadar, because it was not conducted in a legal manner. The procurement of goods for the needs of the restaurant in the amount of around 100.000 euros was carried out outside the public procurement system, by direct negotiation without a public invitation and tender, for which a criminal complaint was submitted to the Special State Prosecutor's Office. The operation of the restaurant "Jezero" is governed by improper recording of the procurement of goods and turnover, without defined norms and without standardized standards for recording stocks. This has led to the fact that it is almost impossible to determine the actual situation in relation to cash flows and records of turnover related to the restaurant's operations. , claim the company, which did not clearly answer the question of "Vijesti" when it will submit the report.
According to the company, the decision of the previous management, which rejected all offers from bidders for the lease of the restaurant as incorrect, was contested by a lawsuit before the Administrative Court, and the current management, by reviewing the documentation related to that procedure, noticed irregularities that were committed with the intention of using the restaurant for the personal interests of the individuals who managed it.
"Taking into account all the listed open questions, the management is taking all steps to make the restaurant ready and open for the beginning of the season. The current management is determined not to allow a single cent of the company to be spent inappropriately, and especially not to allow the huge resources available to the company to be used for the personal interests of privileged individuals who were in decision-making positions in the previous period. We urgently call and have repeatedly called the competent inspections and especially the Special State Prosecutor's Office (SDT) to enter the company and establish all the facts in order to put an end once and for all to the question of who is destroying or was destroying the company", the National Parks pointed out.
The company claims that because of this attitude, the management is faced with physical attacks and threats directed at the members of the management personally and their families, and that "former employees were involved in facilitating illegal business through their work, and they take it as their right to influence current employees in order to convinced them to cover up the facts and the actual situation regarding the business of the company".
The prosecution rejected the criminal complaint
The source "Vijesti" states that the Basic State Prosecutor's Office informed the company at the beginning of April this year that it will not initiate criminal prosecution against any person for any criminal offense for which it is prosecuted ex officio.
"The prosecutor's office stated that if the company has the opposite opinion, it has the right to file a criminal complaint against a specific person for a specific criminal offense with valid evidence," says the source of "Vijesti".
At the beginning of February, the company asked the Prosecutor's Office to assess whether the employees' actions contained elements of a criminal offense for which they are being prosecuted ex officio.
Income growth of 33,73 percent
The National Parks claim that no previous administration had the will and intention to implement the necessary transformation of the company, to solve the issue of extremely low wages and employee ratios, poaching and illegal logging, but the company's resources were used for personal gain.
"Despite all the difficulties, the new management managed to stabilize the financial situation in five months and regularly settle all due obligations along with the settlement of obligations from the previous period. In the past five months, national parks have recorded an increase in visitors by 160,40 percent compared to the same comparative period of the previous year, i.e. they generate about 100.000 euros more in income. A 33,73 percent increase in total revenues was recorded. Those results were preceded by serious preparation of the new management of the company and its units, better control of billing records, better engagement and organization in the field", said the National Parks.
The company said that they are ready to solve the most difficult issues related to business and that they expect the support of the relevant ministry for this.
