Technoput continued with illegal production of asphalt?

The Tehnoput company continued with the illegal production of asphalt, although it turned out that the company's asphalt base has been operating for years without a construction permit, and despite the order of the construction inspection to close it, reports the portal. Zoom in.

They state that, after being informed that the asphalt base of Tehnoput was working and after being sealed by the construction inspection, they visited the shore of Cijevna at dawn and found that the asphalt base of Tehnoput, which is located on state land, was working and filling the company's trucks with asphalt raw material.

The portal reports that the Ministry of Ecology, Spatial Planning and Urbanism said that the asphalt base never had a construction permit.

"Based on an inspection of the records of the urban planning and construction inspection and the available data, there is no approval issued for the asphalt base facility at the location in question in accordance with the law for doo 'Tehnoput' Podgorica. Urban planning and construction inspection is a procedure in accordance with the Law on Spatial Planning and Construction of Buildings, which prescribes authorizations and administrative measures in the part of control of objects of supervision, i.e. buildings. The urban planning and construction inspection passed the administrative measure prescribed by law prohibiting the use of the buildings in question and officially sealed them, considering the legal possibilities and the planning document that treats the location in question, and in accordance with the determined irregularity", according to the responses of the building inspection.

From the Zumiraj portal, they state that the base of the city company "Roads" was also sealed, which followed the order of the inspection and entered into the procedure of installing a new asphalt base and obtaining the necessary documentation.

The plots on which the Tehnoput asphalt base is located are state-owned and there is no Tehnoput property on them, the portal points out.

"Plots 138/10 and 138/3 KO Cijevna are owned by the state, and were given to the city company 'Roads' for use, and there are no encumbrances or restrictions on them, nor any trace of the asphalt base of the Technopath with mechanization. has repeatedly tried to obtain a building permit, since 2012, when he started preparing part of the documentation, but in the attachments of the documentation required for the building permit, he never attached on the basis of which he was using state property, and the issuing procedure was suspended several times due to the administrative process which was initiated by the Regional Waterworks," the Zumiraj portal states.

That, they add, is not the only dispute - according to the claims of the local self-government in Podgorica and the management of "Puteva", a lawsuit was filed against Tehnoput in 2018 due to the usurpation of those plots.

"Before the Basic Court in Podgorica, proceedings are being conducted on the lawsuit of the Capital City and 'Puteva' doo, against the defendant 'Tehnoput' doo, for the purpose of freeing the immovable property from persons and things and acquisition without grounds. The specified procedure of the final mark P. no. 2615/18 has been in effect since 2018, and the defendant had previously started using the immovable property registered as cat.parc.138/10 and 138/11 from ln 693 KO Cijevna, owned by the Capital City, without a legal basis. We expect that the first-instance verdict will be handed down soon", it is stated in the answers of the Capital City.

The Zumiraj portal reminds that the environmental inspection went to the field several times and controlled the measures from the Elaborate on environmental impact assessment, which was approved by the Environmental Protection Agency in 2013. The process for issuing a permit for the asphalt base was never completed, because there was no proof of the payment of utility fees, but also because the Regional Waterworks appealed against the decision of the Water Administration, which was later annulled because the asphalt bases are located in the wider protection zone of the source. Better sisters”.

"Consequently, polluters cannot be issued a water permit because there is a risk of water and air pollution, which can affect the source of the 'Bolje sestre', and therefore the Elaborate on environmental impact assessment without a construction and water permit is an empty letter on paper , but the acting inspectors did not adhere to that, but acted as if the base had all the necessary permits, and they did not inform the competent building inspectors of the lack of permits," the portal adds.

They state that by visiting the field, they were convinced that Cijevna has dried up, and that the only surface water is precisely the waste water coming from the direction of these plants. Locals claim that it is waste water that is produced in plants located on the banks of the Cijevna.

"When it came to giving consent for the asphalt base of 'Tehnoputa' DOO Podgorica. By letter No. 01-15/5715 dated 27.04.2015. in 01, a request was made to the Environmental Protection Agency for invalidating the consent to the Elaboration of the Environmental Impact Assessment for the construction of an asphalt base; By letter No. 15-5713/27.04.2015 of April 060, 327. year, a request was made to the Ministry of Agriculture and Rural Development for the annulment of decision no. 14-02012/206-06.02.2015-01 from 15. years; By letter No. 714-27.04.2915/XNUMX of April XNUMX, XNUMX. The Ministry of Sustainable Development and Tourism - the Directorate for Environmental Protection and Climate Change was asked to cancel the consent issued to the investor "Tehnoput" DOO Podgorica, according to the answers of the Regional Waterworks prepared by the director Zoran Lakušić.

They add that asphalt bases must be moved from this protection zone:

"Thanks to the aforementioned letters and many other activities, i.e. pressures led by the Regional Waterworks, the consent of the Ministry of Sustainable Development and Tourism for the operation of the asphalt base of the investor 'Tehnoput' DOO Podgorica was withdrawn. The regional water supply company is still of the same opinion, that is, it will not allow any construction of commercial and other facilities that are forbidden to be built in the sanitary zones of water source protection and which can significantly threaten the quality of water in the source, and requires the urgent removal of asphalt bases", the water supply company warns.

They point out that the illegal bases should have been removed a long time ago.

"Asphalt bases as illegal facilities should have been removed a long time ago, and someone should answer why they continue to operate unhindered. With the storage of oil derivatives and various industrial processes, asphalt bases potentially seriously threaten the water quality of the Bolje sestre spring. This calls into question the sustainability of the entire water supply project for the Montenegrin coast, one of the most important infrastructure projects in Montenegro, worth over 100.000.000. euros, as well as the realization of investments in the field of tourism on the Montenegrin coast, worth over 3 billion euros," the answers state, as reported by the Zumiraj portal.

The Regional Water Supply also states why asphalt bases are dangerous for the source.

"Considering that the operation of the asphalt base causes the release of chemicals into the air during production, including many toxic air pollutants such as arsenic, benzene, formaldehyde, cadmium, phenol and hexane, it is unacceptable and unfair to pollute the Morača River and the team itself in this way the Bolje sestre water source is endangered", they conclude.

Locals have been complaining to the competent authorities and the Directorate for Inspection Affairs for years, but they did not know until recently that the asphalt bases were operating illegally, but the competent services, they say, always assured them that the investors were complying with the measures from the Elaborate, according to the Zumiraj portal.

They said that Technoput did not answer questions.

Tehnoput was founded in 2002, Saša Aćimić is listed as its founder and director on the portal of the Central Register of Business Entities (CRPS). Portal Zumiraj states that they tried to contact Aćimić directly, but he did not respond to messages.

"The illegal asphalt base of Tehnoput has been operating for almost a decade, according to citizens who live near the base, which means that the asphalt produced by Tehnoput ended up in state and local projects," the portal concludes.
