The public enterprise for the management of the maritime resource is not giving up the property of the Yugoslav River Shipping Company (JRB), the only question is whether it will enter into the process of buying or taking over the land.
This is what the director of JP Morsko dobro, Mladen Mikijelj, said to "Vijesta", stressing that documentation from the cadastre is awaited, in order to see the chronology of entries on the plots that are the subject of sale, that is, to determine who the owner is.
The protector of property and legal interests of Montenegro, Bojana Ćirović, requested that the auction for the sale of the building of the former Yugoslav river shipping near the Old Town, which was advertised by the bankruptcy administrator of the company "Vektra Montenegro" of businessman Dragan Brković, be postponed until the disputed issue of the property and legal regime on the land subject to sale is resolved, because it was established that the real estate is registered to the state of Montenegro. She sent that request to the Minister of Ecology, Spatial Planning and Urbanism, Ana Novaković Đurović.
Mikijelj said that the Public Company Morsko dobro asked the Budva branch of the Administration for Cadastre and State Property to deliver the chronology of entries on cadastral parcels, in order to resolve disputed issues of the property-legal regime.

"According to the sixth advertisement for the sale of part of the assets of the bankrupt debtor 'Vektra Montenegro', by public collection of written offers in sealed envelopes, the possibility of selling individually according to the points of the advertisement was given - individually for the municipality of Budva, land area of 5.454 square meters and buildings 815 square meters, use of 1/1 of 'Vektra Montenegro' and property of 1/1 of the state of Montenegro. Appreciating that the state is the owner of the land, and 'Vetra Boka' is the user, the Public Enterprise for the Management of Marine Assets proposed to the line ministry to obtain the opinion of the Protector of Property and Legal Interests of Montenegro. The protector assessed the registration of property rights on the land in the scope of rights 1/1 of the state of Montenegro as disputed and requested a postponement of the sale of the property until the disputed issue of the property-legal regime on the land is resolved," said Mikijelj.
At the end of August, the Mayor of Budva, Milo Božović, sent a letter of intent to the Public Enterprise for the Management of the Sea Property, requesting that the state company that manages the coast buy the JRB building, which is normally located in the zone of the marine property, because the local government was prevented from participating in the auction on September 19, when it was scheduled. As the reason, Božović stated that this year's budget did not foresee the allocation of eight million euros for purchases.
The bankruptcy creditor in the proceedings before the Commercial Court for the bankruptcy debtor "Vektra Montenegro" announced the sale of part of the property by public collection of written offers in sealed envelopes. The subject of the sale are real estate whose estimated assets total 14,6 million euros, of which the JRB building is valued at 7.970.000 euros.
At the end of August, the bankruptcy administrator informed the Municipality of Budva that, if the local administration or a state body intends to purchase the real estate of the former Yugoslav river shipping, they can apply in accordance with the prescribed procedure.
The Ministry of Finance supported the initiative for the purchase of the real estate of the former Yugoslav river shipping company from its own resources of the Public Enterprise for the Management of Maritime Assets, if it is selected as the most favorable bidder, noting that the final decision is made by the Government.
Dragan Brković, close to the political top of the DPS, traded an attractive property almost two decades ago for three million euros from Nenad Đorđević, a citizen of Belgrade, a former high-ranking official of JUL.
For years, Đorđević, who was also the owner of the land complex on the island of Sveti Nikola, and which he later sold to Stanko Subotic Canet, intended to turn JRB into a hotel, build a small marina and other accompanying facilities for high-paying clientele, however, as he was not allowed to do so, because no planning document had been brought, he decided to sell it. At the zenith of business success, the Podgorica company "Vektra" entered the scene.
Even Brković did not manage to realize his visions immediately, during the investment boom, when many foreign businessmen were interested in investing in Budva. On its website, "Vektra" previously had a detailed elaboration of all the projects it intends to implement, including plans for JRB.
Brković pledged this property in the name of credit lines of a total of 60 million euros with domestic and foreign banks. The building has been falling into disrepair for years, and in previous years there have been initiatives from the Municipality to buy the building and return it to the ownership of the city.
Last year, the Administration of Local Public Revenues of the Municipality of Budva initiated the procedure for forced collection of a tax claim in the amount of 170 thousand euros from "Vektra Montenegro", and after it was not settled, a mortgage was registered on the JRB building.
The protector stated in her request that the facility is the property of the state, and that "Vektra" has the right to use it.
"Taking into account the submitted documentation and the applicable legislation, specifically the law on state property, the protector does not have jurisdiction in relation to the previous acts, and this bearing in mind that in the specific question are entities that have the status of a legal person, and in this context there is no place for the application of articles 53 and 56 of the Law on state property. All the more so because local self-government units have legal representatives of property-legal interests whose competence is to give opinions on acts of local self-government bodies, and therefore on the letter in question. However, after the protector inspected the electronic database of the Administration for Cadastre and State Property real estate list number 343 KO Budva in the B list, he notes the property in the extent of 1/1 of the State of Montenegro, which he finds disputed and will initiate the postponement of the sale of the property in question in the bankruptcy proceedings until the controversial issue of the property legal regime on the land that is the subject of sale is resolved," the letter reads.
