The Management Board of the Labor Fund prevents the appeals of other candidates in the competition for director by directing them to start a dispute before the Administrative Court, although in a similar case that court instance declared itself incompetent.
This is stated in last week's decision, according to which the Management Board of the Labor Fund elected a director for a five-year term Vesna Ćalović, which was the worst ranked in the competition.
The Management Board forwarded the decision to the Human Resources Directorate.
In the document, which "Vijesti" has access to, the legal instruction refers to the other two candidates Ana Mrdovic i Jelisaveta Zorić Jović to appeal the decision to the Administrative Court.
At the beginning of the year, that court announced itself as having no jurisdiction in the case of the election of the third-ranked candidate in the competition for the director of the Employment Agency Goran Folić. It was established that the Governmental Appeals Commission is the competent authority, to which candidates who are dissatisfied with the outcome of the competition turn. In the case of the Employment Agency, appeals were forwarded to the Government Commission only after the Administrative Court declared it incompetent, so the election of Folić was annulled a year after the adoption, and he was appointed director.
Complaints have also been announced in the case of the election of the director of the Labor Fund, so the same scenario can be repeated, as in the case of the Employment Agency.
Deputy Chairman of the Board of Directors Nadja Pekić who signed the document addressed to the Human Resources Administration, told "Vijesti" that the Fund does not have a president of the Board of Directors, so she, as the vice president, "was forced to sign the document."
"I'm a psychologist and I don't know the legal circumstances, and time will tell if we made a good choice. I think we are," said Pekić, in response to the question of "Vijesti" whether they are familiar with the "Folić case" and whether they know that the Administrative Court is not an address for appeals.
In the document forwarded to the Human Resources Administration, it is stated that out of nine members of the Board of Directors, six supported the election of Ćalović as director, two were against it, and one member of the board abstained.
"The selected candidate showed a high level of expertise and knowledge from the competence of the Labor Fund, clearly and concisely presented the directions of future work. She placed special emphasis on the improvement of the information system, which would ensure the download of data from other institutions and enable the parties to follow the procedure from the submission of the request until the payment of the claim," the document states, adding that Ćalović made concrete proposals related to improving efficiency. in acting on the requests of the parties for the exercise of rights.
Before the final decision, the Board of Directors of the Labor Fund conducted interviews with the three best-ranked candidates for the director of that institution.
It is disputed that in the invitation to the candidates, according to "Vijesti" information, they asked them to also submit the written work they had before the committee of the Human Resources Administration, in order to be re-scored, which is contrary to legal responsibilities and current practice.
The Human Resources Administration (formerly the Human Resources Administration) announces competitions for the entire state administration and conducts testing and scoring of all candidates, and submits a list of the top three candidates to the institution for which the selection is made.
There were seven candidates on the test. On the test, the highest score, 43, was obtained by a long-time employee of the Labor Fund and its acting director from the period of the 42nd Government. Ana Mrdovic. Current acting director Jelisaveta Zorić Jović she had 36 points, and she was the former secretary of the Ministry of Public Administration, which she managed at the time Suzana Pribilović, Vesna Ćalović 34,33 points.
This list of candidates was sent to the Management Board of the Labor Fund on May 18 of this year.
However, at the session of June 6, the Board of Directors, by overvoting, came to the conclusion that, in addition to the curriculum vitae, the candidates must submit the written work that they presented to the Human Resources Committee, in order for them to re-evaluate and score them.
According to "Vijesti" information, the Human Resources Administration refused to participate in this.
The Management Board of the Labor Fund now has nine members, four representatives of the previous Government consisting of URA, SNP, DPS and minority parties, one employee representative, two from the Employers' Union and one each from the Union of Trade Unions and the Union of Free Trade Unions.
"Vijesti" previously announced that until now, in connection with this competition, the majority were representatives of employers, trade unions and a member of the DPS in front of the Government. That group was satisfied with the choice of Ćalovićka as director, which is why they asked that they evaluate the testing.
Mrdović also had the most points on the test last year, but that competition was later cancelled.
Of the nine members of the Board of Directors, six supported the election of Ćalović as director, two were against it, and one member of the board abstained.
