In the tourist-nautical resort of Porto Montenegro, the construction of a new condo hotel could soon begin on the site of the current heliport, with the fact that the building will additionally enter the sea by another 200 square meters.
According to the model, exhibited in the nearby "Regent" hotel and used to attract customers, the future building with five floors will be surrounded by the sea on three sides.
This is made possible by the contentious amendment of the planning document State study of the location "Arsenal" adopted in 2019, for which the investor has meanwhile received urban planning and technical (UT) conditions and started preparatory work for construction.
At the end of last year, a group of residents of the Seljanovo settlement in Tivat filed a criminal complaint with the Special State Prosecutor's Office against Mladena Krekića the executive director of the company "Business Art", as the then manager of the development and responsible planner of DSL Arsenal Tivat, and responsible persons in the then Ministry of Sustainable Development and Tourism due to suspicions that they abused their official position during the preparation and acceptance of changes to this plan.
Modification of the investor's profit plan
The applicants, which "Vijesti" had access to, believe that the author of the plan and those responsible in the then ministry violated several laws and other regulations in the field of spatial planning, as well as that they acted in an organized manner to enable the owner of the settlement, the company "Adriatic Marinas", to build as much residential and commercial space as possible, and thus the acquisition of large profits at the expense of public space, the nature of the sea coast, registered cultural assets and the inhabitants of Seljanovo.
This was the third amendment to the disputed plan, and with each one, new buildings were added to the space on the seashore, with increased dimensions and storeys. Due to the new increased number of floors, the residents of Seljanovo will have a completely obscured view of the sea.
With the new changes compared to the previous one, construction possibilities have been drastically increased in most locations. Thus, the permitted gross construction area at the location UP1-17 was increased from seven to 31 thousand square meters, and at UP1-19 from 150 to 5.861 square meters.
These changes to the planning document DSL "Arsenal" were requested by "Adriatic properties", and the Ministry of Sustainable Development and Tourism at the time accepted it in 2019. In XNUMX, they give guidelines to the developer of the plan, Krekić, so that "the investor directs investments in the direction in which the current economic situation gives him the most possibilities".
Locals believe that in this way, with abuse of position, "Adriatic Marinas" is placed in a privileged position compared to any other investor or citizen who owns property within the scope of this plan, and that the changes made prove that the economic interest of this investor is and his profit making is the main reason for changing the plan.
Cultural heritage "cannot be kept"
In addition, it was stated in the application that the designer Krekić predicted that it would be necessary to remove the remains of the medieval summer house Rateli, a registered cultural heritage, in order to build commercial and residential buildings in its place. As an explanation in the DSL, it is stated "that it is not possible to keep the complex in its current position due to the complexity of the facilities provided for in the plan".
Also, construction is planned on green and free sites near the old Annunciation Church near the Army House, so that two buildings of five floors each will be built just ten meters around the church.
The current area of the heliport was "gained" by filling up the sea, and now it is being further expanded at the request of the investor.
On November 18 of last year, the current Ministry of Ecology, Spatial Planning and Urbanism issued to the company "Synchro PM", whose owner is "Adriatic Marinas", urban technical conditions for the construction of a mixed-use building - a condo hotel on the location of the heliport. As stated in this Ministry document, the urban plot on which the building will be built consists of "cadastral plot 965/23 KO Tivat, part of cadastral plot 185/2 KO Tivat and part of the Adriatic Sea".
During the period of activities on changes to this plan, the ministry was managed by the then minister Pavle Radulović, and then, after his resignation, the then prime minister Dusko Markovic.
The prosecution still has no answer
Regarding the criminal complaint, but also the preparations for the construction of the disputed building for which urban planning and technical conditions were issued, "Vijesti" asked the Special State Prosecutor's Office three weeks ago what happened to the report submitted eight months ago and whether they have carried out any investigations so far actions. SDT did not answer this question.
"Vijesti" also sent questions to the author of the disputed plan, Krekić, but his office said in a telephone conversation that he did not want to answer the questions because he was not familiar with the application. When asked whether the wishes of the investor "Adritic Marinas" were met during the development of the plan, the answer was only that everything was done in accordance with the laws and rules of the profession.
Neither "Adriatic Marinas" nor the Ministry of Ecology, Spatial Planning and Urbanism answered the questions regarding the changes to the plan, the criminal complaint and the construction of the disputed building. The Ministry did not even respond to the question of whether they will request a review of this plan.
Marine well confirmed: The building will enter the sea
Due to the fact that the issued urban planning and technical conditions stated that the contested building will be built on an urban plot consisting of "cadastral plot 965/23 KO Tivat, part of cadastral plot 185/2 KO Tivat and part of the Adriatic Sea", "News" have also sent questions about this unusual case to the Public Enterprise for the Management of Marine Assets.
From this institution, they replied that by looking at the planning document and parcelization, they determined that the future building enters the Adriatic Sea in an area of 215 square meters.
They also explained that when issuing the UT conditions, it is not foreseen to obtain the consent of any administrative body, and therefore not even the Maritime Property.
They said that during the public debate on the amendment of the DSL Arsenal in July 2019, they submitted their opinion to the Ministry in which they asserted that the technical solution of the urban plots by the sea and the coast must provide free access to the coast and the sea.
"Morski dobr's position is that when adopting the DSL or amending it, the remarks, suggestions and initiatives of the locals for the locations for which the planning documentation is being brought should be considered with great care. All of the above for the reason that the resident population has the best insight into the functioning of the space itself and the need for interventions in it. Also, special emphasis should be placed on the fact that when preparing all planning documents, especially those that detail the narrow coastal strip, care should be taken in planning, bearing in mind that it represents an area of special value and that it is necessary to preserve natural beaches and space in the best possible way. to connect with the sea and the sea coast with objects of public interest. Therefore, when planning the space, the public interest should be taken into account, and everything with the aim of preserving the coast must always have priority over individual requests", stated the Morski Dobr.
