Former CEO of Pljevlja Coal Mine (RUP) Milan Lekic (Nova) filed a lawsuit asking the Basic Court in Pljevlja to cancel, as he claims, the illegal decision of the Board of Directors on his dismissal, which, he points out, has already had harmful consequences for this state-owned company. He also asked the court to adopt a temporary measure until the court proceedings are completed.
Lekić was recently dismissed by the Board of Directors, after the labor inspection determined that he was not selected for that position through a public competition, which was a legal obligation.
In the decision he made on August 18, 16 days after conducting an inspection at the initiative of the Alternative Institute, the labor inspector Veljko Vlaović he ordered the president of the Board of Directors of the Coal Mine Dušan Janjušević (Democrats) to eliminate irregularities within 20 days of receiving the decision.
Yesterday, Lekić did not want to comment on the details of the lawsuit, because as he said, the court has already formed the case and is conducting the proceedings.
"The lawsuit refers to the annulment of the decision on my dismissal for the reason that I was dismissed by the Board of Directors headed by President Dušan Janjušević, who was illegally appointed to the Board," Lekić told "Vijesta".
The board of directors of RUP elected Lekić as executive director on April 12, 2021 for a period of four years.
Lekić also submitted a report to the labor inspectorate because he claims that Janjušević was elected to that position illegally.
According to unofficial information from "Vijesti", the inspectorate visited RUP yesterday and checked the allegations from Lekić's application.
The sacked executive director of RUP claims that Janjušević was elected for the first time as the president of the Board of Directors, even though he did not meet the conditions prescribed by the company's Statute, nor by the Rulebook on the systematization of workplaces.
According to Lekić, Janjušević was elected to that position even though he did not have five or three years of work experience in the profession, which is stipulated by the Statute and the Rulebook on the Systematization of Jobs.
That is why, he believes, all the decisions of the Board of Directors of the Mine are illegal.
On the other hand, Janjušević claims that he met the required conditions, accusing Lekić of "wanting to mask his lawlessness, evasion and actions before the SDT by challenging others".
He also said that he understands Milan Lekić's position "which is burdened by the actions of the SDT, various inspections, gross violations of the law, evasion of severance pay, harmful jobs and other activities that characterized his mandate".
In accordance with the systematization of jobs, the president of the Board of Directors, in order to be elected to that position, must have 3 years of experience at the VII level of education, which Lekić claims, Janjušević did not have when he was first elected to that position in March 2021.
"Dušan Janjušević, the then and current president of the Board of Directors, graduated in March 2021 from the Faculty of Technical Sciences in Čačak, and already in April of that year, he became the president of the Board of Directors. Even in theory, which is completely clear, it is not possible that in about a month from graduation to appointment, he gained three years of experience in the level of education required by systematization for that position. So it was in 2021, that is, in that year, without a day of work experience in the profession, in the required level of education, Mr. Janjušević was illegally appointed as the president of the Board of Directors. As he is appointed to that position for a period of one year, we have come to a situation where the re-appointment of Mr. Janjušević in 2022 was also illegal, because in the meantime he gained only one year of experience in the place where he came illegally. With the expiration of his mandate in 2023, Mr. Janjušević was illegally appointed for the third time, this time with two years of illegally acquired work experience," claims Lekić.
He points out that only in 2024, Janjušević would have three years of work experience with a seventh degree, when he would continue his mandate, and would be in a position to be appointed to the same position again that year.
According to the Statute of the RUP, which "Vijesti" had access to, a candidate with at least a seventh-level vocational education, professional knowledge and experience in the fields of mining, energy, finance and law, as well as work experience of at least five years in the profession.
According to the rulebook on the Internal Organization and systematization of jobs, it is stipulated that the president of the Board of Directors must have three years of work experience and a seventh degree.
Janjušević claims that the Board of Directors of Elektroprivreda, when appointing him, complied with the statutory provisions of the Coal Mine, which prescribes the conditions for a member of the Board of Directors.
