The Ministry of Capital Investments (MKI) asks the Council of the Civil Aviation Agency (ACV) to consider the possibility of canceling the competition for the selection of directors and announcing a new one in accordance with legal regulations. To the address of the director of the Directorate for Inspection Affairs Ana Vujošević there was also a whistleblower's report from the Agency, who requested an urgent inspection regarding the events with the election of the director.
"Vijesti" has access to the document of the Minister of Capital Investments Ervin Ibrahimovic referred to the president of the ACV Council Dejan Stojanović, as well as the letter filed in the Directorate for Inspection Affairs.
He was elected at the end of August in the competition for the executive director of ACV Vladislav Vlahović, who at the beginning of that month, at the suggestion of Ibrahimović, was dismissed by the Government from the position of Council member in that agency because it was discovered that he did not meet the legal requirements for that position.
Due to the election of Vlahović, the Government dismissed the previous Council that he headed Dženan Kolic and appointed a new one headed by Stojanović, and the whole case ended up with the special state prosecutor after the whistleblower from the ACV reported Vladimir Novović because Kolić allegedly falsified the conditions of the competition.
The new CAA Council was appointed in mid-October Mile Nikolić for acting director until a new director is selected in a new competition, and since the procedure for the August competition has not been completed, they asked for the position of the MKI.
In the letter, Ibrahimović states that he is responding to Stojanović's letter dated October 24 of this year and "on the basis of which the CAA Council determined the proposed decision on the appointment of the director at the session of October 16."
"It is necessary that, within the shortest possible period of time, the CAA management body headed by you, within the framework of its competences, with special attention, inspects the documentation in the CAA's possession, starting from the application for a vacant position, through the announcement of the competition until now, and examines the circumstances under which a competition was announced. You need to determine whether the competent procedure was carried out in a transparent and legitimate manner in accordance with current legal acts. In addition, you should check whether the proposed candidate must be retired by law. The relevant ministry is of the opinion to consider the possibility of canceling the competition and announcing a new one in accordance with the legal regulations of Montenegro", Ibrahimović stated, among other things, in the letter.
Ana Vujošević, director of the Directorate for Inspection Affairs, received a report from a whistleblower from the Agency who requested that an urgent inspection be carried out in connection with the events with the election of the director.
In the application to the Directorate for Inspectional Supervision, it is stated that the Council appointed the acting director in October, but did not inform the candidates in the competition about the final decision.
"I point out that the Council acted contrary to the Labor Law because it did not inform the candidates from the competition about the final decision on the competition within 45 days from the day of the election of the director according to the public competition. Also, it is not clear why the acting director was elected, given the fact that there was and was a procedure based on a public competition, and it is not clear what happened to the decision based on a public competition and why the candidates were not informed about the outcome of the procedure. I ask that you carry out an inspection without delay and order the CAA to cancel the decision on the appointment of the acting director and act according to the conditions of the competition, and finally to cancel the competition and announce a new one", the letter to Vujoševićka says.
