In the dispute between the company "BB Hidro" and the state regarding the construction of the small hydropower plant (MHP) "Slatina" on the river of the same name, the designer of the main project will also be heard. Bojan Bosković, after the auditor previously testified Ljubomir Bosković and co-owners of a private company Ivan i Slaven Burzanović.
That decision was made by a judge at a hearing in the Commercial Court yesterday Marija Adzic, and scheduled the continuation of the dispute for February 15.
The company "BBH" of which he is a co-owner Blazo Djukanovic, the son of the former president Milo Đukanović, is seeking compensation from the state for damages and lost profits, because they were prevented from building the small hydroelectric power plant (MHP) "Slatina" on the watercourse of that river in Kolašin, despite the fact that they were issued an energy permit for it based on the concession agreement from 2017 . The value of the dispute should be determined by an expert.
This company claims that they fulfilled all the obligations defined by the Concession Agreement for the construction of MHP on the "Slatina" river in Kolašin on time, while the state did not fulfill its contractual obligations on time, nor did it respond to the numerous emergencies it received.
At the hearing, the executive director of "BBH" Ivan Burzanović also spoke briefly, who explained that he had previously made a mistake in his statement and that none of the 27 parcels that were the subject of expropriation were owned by that company. Lawyer "BBH" Milja Đuranović she added that she would submit the evidence on this later, while Burzanović emphasized that they had approached the Cadastre Administration with that request several times.
Deputy protector of property and legal interests of the state Radomirka Raičević objected to these statements and said that they did not match the previous statements.
During the hearing, the auditor of the main project Ljubomir Bošković, whose company "Sistem MNE" audited the project, explained that he was in charge of reviewing the main project done by the company "Permonte". He said that after that they submitted a positive report, which made the building ready for construction. In response to the question of the lawyer "BBH" about possible delays in the project, he emphasized that it is not in the interest of the investors to delay and that the company was precise in everything.
He explained that the MHE "Slatina" had a larger capacity, but that they were obliged to limit its power for the sake of the Ministry of Economy, which it then managed Dragica Sekulić, from which they demanded that the machine building be withdrawn to a certain altitude. This was requested, as he said, so that the submergence of the HPP would not occur if hydropower plants were built on the Morača River.
Protector Raičević emphasized that she remains with the objection that a conceptual solution should be made for "Slatina", based on which urban conditions would be issued and then technical as well as a construction application. And that for that the main project had to be done and revised.
The lawyer of "BBH" pointed out that in the submitted files there is a record of the competent inspector who stated that the documentation was completed for "Slatina" and that they had already made a statement in this regard. She stressed that the auditor cannot comment on legal issues and again suggested that the designer Bojan Bošković be heard at the next hearing. Raičević did not object to that, but left the decision to the court. Judge Adžić accepted the request and scheduled the continuation of the hearing for February 15.
