Nebojša Jušković addressed the Minister of Transport and Maritime Affairs, Filip Radulović, regarding the competition for the election of the director of the Civil Aviation Agency, which he canceled, as the Council of the Civil Aviation Agency claims was illegal and illegitimate.
In his address, he blames Radulović for the events and irregularities in the work of the Council because, he claims, he illegally ordered the Council to postpone the session at which candidates' applications would be considered.
Jušković states that two of the five members of that body are in a conflict of interest in accordance with the provisions of the current Air Traffic Act.
In his letter to Radulović, he says that August 15, 2023. year, and in accordance with the published Decision on the announcement of a competition for the selection of the director of the Civil Aviation Agency, he submitted an application for the competition for the director and at the same time submitted all the prescribed documentation.
"It was only after seven months that the acting authority issued Notification No. 01/1-014/23-1558/57 dated March 20.03.2024, XNUMX. year in which I was informed that the CAA Council made a decision canceling the competition for the election of the Agency's director, without stating the reason for the cancellation and without submitting the decision referred to by that body in the respective Notice", he claims.
"This especially considering the provisions of Articles 26 and 27 of the Labor Law, which the authority itself refers to in the Notice in question, and which it violates at the same time. The provision from Article 26 of the Labor Law prescribes that the employer informs the participants of the advertisement about the selection of candidates within 45 days of the deadline for submitting the application, while the provision from Article 27 of the Law of the same name stipulates that the employer can make a decision to cancel the vacancy advertisement place within 45 days from the day of its publication, due to changes in regulations, acts on internal organization and systematization or other justified circumstances arising after publication of the advertisement. According to the above, it is indisputable that the CAA Council did not comply with the legal deadlines and procedure, which it was obliged to do, especially in this state of affairs and decision-making. I would like to point out that I subsequently received Council Decision No. 01/1-014/24-576/1 dated March 18.03.2024, 01. year, where, among other things, it is stated that this competition is canceled and that the Decision on the announcement of the competition for the selection of directors 1/014 -23/1558-1/26.07.2023 dated XNUMX is annulled. year," Jušković said
He adds that on October 27, 2023. year, the inspector of the Directorate for Inspection Affairs, Department for Labor Inspection performed an inspection and ordered that authority to remove the identified irregularities within 10 days, i.e. to act in accordance with the articles of the Labor Law, which, according to Jušković, was not complied with.
Jušković addressed Radulović before, but the minister's answer was absent. Jušković claims that Radulović was obliged to respond because he directly entered the zone of violation of his political and human rights, i.e. the right to work.
"I don't expect you to act on this address either and eliminate irregularities in the work of the ACV Council. This is because you are the direct culprit why the Council in its previous composition did not act according to the orders of the Directorate for Inspection Affairs since you illegally ordered the Council to postpone the session at which the applications of the candidates and irregularities pointed out by the inspection body would be considered. I am also aware that the Council announced a new competition, and canceled the previous one illegally under your direct influence. With this behavior, you have brought the work of the Agency into the zone of legal confusion and uncertainty, all with the aim of bringing PES=DPS personnel to the head of the Agency.
