Nebojša Jušković, who was a candidate of the Coalition "For the Future of Montenegro" for a member of the Council of the Civil Aviation Agency (ACV), and who did not pass the security assessment, filed a criminal complaint against the Minister of Maritime Affairs and Transport Filip Radulović for several crimes.
In the criminal report against Radulović, which he submitted to the chief special prosecutor (GST) Vladimir Novović, he stated that he filed the report against Radulović for the criminal offense of abuse of office under Article 416, paragraph 1 of the Criminal Code of Montenegro and Article 417, and in relation to Article 23, as and the criminal act of unlawful influence from Article 422 paragraph 2 of the Criminal Code of Montenegro (hereinafter referred to as the Criminal Code of Montenegro).
"The suspect is reasonably suspected that, in his capacity as an official, as the Minister of Transport and Maritime Affairs of the Government of Montenegro, aware of the act he wanted to commit, he committed the above-mentioned criminal offences, by doing so, in the manner that he did during the performance of his duties as the Minister of Maritime Affairs and Transport illegally postponed the meeting of the Civil Aviation Agency (ACV) on November 09.11.2023, XNUMX, and before the expiration of the illegal deadline, the Government dismissed the Council without argument. The new Council was elected after three months, with the proposal of certain candidates, who on several legal grounds, they could not be members of this body. With this choice and composition of the Council, the legitimacy of its work was called into question," Jušković pointed out in the application that "Vijesti" had access to.
He added that the suspect Radulović also illegally exerted influence on the newly appointed CAA Council to illegally cancel the competition for the election of the CAA director from July 26.7.2023, 22.4.2024, and announce a new competition for the election of the CAA director on XNUMX/XNUMX/XNUMX.
"This is especially the case with the fact that, using his position as a minister, the suspect illegally influenced the CAA Council to illegally elect on 20.05.2024 a person who could not be elected according to Article 9 paragraph 8 and Article 12 paragraph 3 of the Air Traffic Act. In addition to the above of the aforementioned criminal acts, the suspected Minister of Transport and Maritime Affairs committed political discrimination against the proposed candidates for the CAA Council members, thereby entering the zone of violation of political and human rights and the right to work, which grossly violates the Constitution of Montenegro, namely Articles 6,8,10,17,19, 47, 416, 1 , 417, and 23. In this way, the suspect intentionally committed the criminal offenses that I am charging him with in this report, and for an extended period of time. 422 and Article 2, and in relation to Article XNUMX of the Criminal Code of Montenegro as well as the criminal offense of unlawful influence from Article XNUMX paragraph XNUMX of the Criminal Code of Montenegro, for which reasons I am asking you to act on the criminal report and verify the listed suspicions," Jušković said in the report.
