The Basic Court in Pljevlja annulled the Decision of the Board of Directors of the Pljevlja company Čistoća on the dismissal of Saša Ječmenica from the post of executive director.
The court ordered Čistoca to pay 484 euros to Ječmenica for the costs of the procedure within eight days of the judgment becoming final. The decision became final on October 25, and enforceable on November 5.
The board of directors dismissed Ječmenica on June 21 last year, with the explanation that "it did not submit a work report for 2022 or a work program for 2023."
Gordana Lekić was elected acting director of Čistoća, who in the meantime was elected director of the company.
Through a lawyer, Ječmenica submitted a request to Čistoća for compensation for the difference in salary, which he currently receives as a property officer of Čistoća and what he would receive as an executive director.
A meeting of the Board of Directors to discuss this will be held on Tuesday.
"Depending on the decision that will be made at the meeting of the Board of Directors on Tuesday, and in consultation with my lawyer, we will decide what further legal actions we will take. The salary of the current director of Čistoća belongs to me, which is significantly higher than the one I received, considering that her salary was increased twice. The earnings of the job belong to me," said Ječmenica to "Vijesta".
He claims that his dismissal was the result of political revanchism and that it had no legal basis, which was established by the court.
"It is obvious that the Board of Directors has not respected the laws of this state since its constitution, which is confirmed by these two judgments. All this has the effect of causing damage to third parties and the Company itself, for which the members of the Board of Directors will be liable with their personal property in accordance with the law," Ječmenica said.
He said that he also received a second judgment against Čistoća, which annulled the decision of the Board of Directors to reject his request to receive compensation in the amount of three quarters of his salary after his dismissal, until the end of his mandate.
Before filing the lawsuit, Ječmenica also approached the Agency for Peaceful Dispute Resolution, but no agreement was reached.
In the explanation of the verdict, judge Sanja Aničić stated that the employment contract concluded by Ječmenica before taking the position of executive director did not provide grounds for his dismissal before the end of his mandate.
