Although the construction of the multimillion-dollar development project of the left coast of Lima, which consists of the construction of a coastal fort and a promenade, is well under way, one illegal object - a garage - has not yet been removed on that route, which is why there is a danger of breaking the deadlines.
The complete project worth 4,5 million euros is financed by the World Bank. In parallel, in the body of the promenade, as told to "News" from the Municipality of Bijelo Polje, a collector for wastewater treatment is already connected, and currently work is being done on the construction of a fishing path with retaining walls as well as a bridge over the Lješnica River near the Health Center.
On the route next to Lim, 15 illegal buildings, which are within the scope of the promenade plan, have been removed, but the investors' machines are still bypassing the garage on the banks of Lim.
Director of the Property and Rights Protection Directorate of the Municipality Ljubomir Sošić he told "Vijesti" that the procedure for resolving property-legal relations, i.e. expropriation, for those buildings was carried out by the then Administration for Cadastre and State Property - Regional Unit Bijelo Polje as early as 2021.
Sošić states that money was paid to 15 building owners at that location.
"For 14 owners, EUR 22.413,55 was paid, while one building owner refused the payment. These are off-book buildings - garages," said Sošić.
Head of the Real Estate Administration PJ Bijelo Polje Rajko Madžgalj confirmed the knowledge of "Vijesti" that after determining the public interest, the expropriation procedure was carried out and the first-instance decision of the Real Estate Administration was made, to which the attorney Wake up Zejaka appealed to the second instance authority, the Ministry of Finance.
Unsatisfied with the offered price, Zejak asked for a higher fee of 10.125 euros for a gross area of about 50 square meters for the building on the very coast of Lim, below the Petoletka building.
"The Ministry of Finance rejected the appeal and thus the decision became enforceable. However, in the meantime, Zejak initiated a dispute before the Administrative Court, in which he requests the annulment of the decision of the Ministry of Finance, which rejected his appeal against the decision of the Real Estate Administration PJ Bijelo Polje", said Madžgalj.
In the complaint, he stated that the construction of the building cost him much more, that the building is equipped with water, sewage and electrical installation, that it is decorated with insulation, tiles...
"The price of that and other buildings was determined in April 2021 by the Commission of the Real Estate Administration before the expropriation began," said Madžgalj.
On September 16, the investor asked the Municipality of Bijelo Polje to remove the garage, which is in the way because it is on the construction route, due to the urgency of the work, explaining that they had been visiting the building until now, but that they had reached a part where they could no longer do so.
On October 8, the municipality appealed to the Real Estate Administration to allow entry into possession, i.e. transfer of real estate to the municipality, in accordance with the Law on Expropriation, "in order to enable the removal of the expropriated building - the garage, which would enable the continuation of work on the construction of the promenade, i.e. the contractor works enabled smooth operation".
"Vijesti" learns that in the Municipality's address to the Administration, it is stated "that it is a case of urgency and that there may be a possible delay and breach of deadlines in the performance of works, which is confirmed by the contractor's address to the Municipality about the necessity of removing the object in question as soon as possible".
After that, on October 18, the Real Estate Administration issued a decision that adopted the request of the Municipality to hand over the real estate based on the executive decision of the Real Estate Administration PJ Bijelo Polje, which ordered the off-book owner Vuk Zejak to expropriate the beneficiary to the Municipality within three days of receiving the decision. hand over immovable property. There has been nothing since the removal so far.
The Administration announced that if the owner of the garage forbids the Municipality from entering the property, it will be followed by the adoption of a decision on the execution of the decision by coercive means.
In the project of building a promenade with a fishing, walking and cycling path, a modern ambient unit will be created, which will completely transform the appearance of Bijelo Polje, because it will open onto the river".
"Bijelo Polje will get a modern promenade with a length of 650 meters, and the deadline for the completion of the works is 18 months. According to the reports of the contractors and supervisory authorities, the work on this project is proceeding according to plan," said the secretary of the Secretariat for Construction. Mensur Hajdarpašić.
He explained to "Vijesti" that the project also envisages the construction of a bicycle path, and that the promenade will have two levels, the first three meters wide and the second six meters wide.
"The construction of the fishing path and sloping stone walls for the fishing path, which is part of the coastal fortification, as well as the retaining walls on which there will be a promenade, as well as the bridge on Lješnica near the health center, is underway," said Hajdarpašić.
He stated that in parallel with the construction of the coastal fort, works are being carried out on the construction of the 450-meter-long collector. The value of these works is 220.000 euros, and the contractor is the company "Nikos cop" from Beran.
