The Commercial Court invited the creditors of the bankrupt former employees of "Radoj Dakić" from Podgorica to submit information to that institution in order to pay their claims.
"We are calling on the creditors - former employees, whose claims were determined by the conclusion of the Commercial Court of January 9, 2018 to be founded, and which have not been fully settled, that is, former employees who are included in the updated report of November 25, which was drawn up by bankruptcy judge Nemanja Popović and bankruptcy trustee Miloš Popović, to submit a certified statement to the Commercial Court in which they will state the number of the current account, with bank confirmation, to which the money will be deposited paid", the announcement states.
The Commercial Court explained that if the creditor whose claim has been recognized has passed away, all heirs must submit separate declarations, along with proof of the right to inherit the claim - a final probate decision of the court or notary.
"If the probate procedure has not been completed or the said claim is not covered by earlier court or notary succession decisions, so it is necessary to pass a supplementary decision or to carry out other actions in accordance with the law, the funds related to the decedent's claims will be deposited in the account of the Commercial Court, until the end of the probate of the procedure", specified in the announcement.
If former workers, or their heirs, want funds to be paid into the account of their attorney, they need to submit to the court a certified special power of attorney authorizing him to receive the amount of money on their behalf.
"In that case, in addition to the certified special power of attorney, it is necessary for the attorney to submit the number of the current account to which the amount will be paid," adds the Commercial Court.
They reminded that the Government adopted information on the need to settle claims from work and on the basis of work for all remaining workers of "Radoja Dakić" in bankruptcy.
"In that direction, the Ministry of Justice and the Ministry of Finance, in accordance with the information received from the Office of the Representative of Montenegro before the European Court of Human Rights and the Commercial Court, determined on the issue of unpaid claims for all remaining employees of "Radoja Dakić" in bankruptcy, on a way to settle the claims of 1,5 thousand former employees of that company, by paying their recognized claims in the amount of 7,79 million euros", the announcement states.
In order to avoid double payments on the same basis from the Government and the bankruptcy administration, the mentioned funds will be paid into the deposit account of the Commercial Court, which, after obtaining the numbers of the creditors' current accounts, i.e. certified special powers of attorney issued to the creditors' attorneys, will make payments to the submitted current accounts of creditors and their proxies.
