Tender for beach lease, mandatory purchase of documentation

The Public Company for the Management of the Maritime Zone of Montenegro announced that only bidders who purchase the tender documentation have the right to participate in the tender.

"Interested bidders or their authorized representatives can download the tender documentation from the Public Enterprise's website or directly at the Public Enterprise's premises. The purchase of the tender documentation is proven by the original payment slip, which must be an integral part of the bid, linked to the other parts of the bid. A bid that does not contain proof of the purchase of the documentation is invalid and will not be subject to evaluation," the Coastal Administration emphasizes.

Mandatory documentation for participation in the tender, when it comes to companies, legal entities and entrepreneurs, is primarily the name and address of the headquarters, the offered price and a statement of acceptance of all conditions and obligations from the Public Invitation and tender documentation.

Consent to the processing of personal data in the procedure is also required - Form A of a public company, proof of registration (Excerpt from the CRPS, not older than 6 months) - original or certified photocopy.

"If the bidder is a foreign company, legal entity or entrepreneur, it is necessary to submit documentation issued by the competent authority from the country in which that person is established, translated into Montenegrin, certified by a court interpreter. A certificate from the administrative body responsible for the collection of tax revenues of Montenegro - the Tax Administration of Montenegro, is also required, confirming that the bidder has settled all due obligations based on taxes and contributions on the date of issuance of the certificate or has been approved for a reprogramming of tax claims that it is regularly settling, which must not be older than 60 days from the date of submission of the bid, original or certified photocopy. A decision on the PIB of the legal entity/entrepreneur, original or certified photocopy," the Coastal Zone emphasizes and notes that if the bidder is a foreign company, legal entity or entrepreneur, it is necessary to submit documentation issued by the competent authority from the country in which that person is established, translated into Montenegrin, certified by a court interpreter, original or certified photocopy. Also, a VAT registration certificate is required, if the bidder is a VAT payer.

"If the bidder is not a VAT payer, he is obliged to submit a certificate from the administrative body responsible for collecting tax revenues that the bidder is not a VAT payer, original or certified photocopy. If the bidder is a foreign company, legal entity or entrepreneur, it is necessary to submit documentation issued by the competent authority from the country in which that person is established, translated into Montenegrin, certified by a court interpreter, original or certified photocopy. A certificate from the competent authority for keeping criminal records - the Ministry of Justice, must also be submitted, confirming that the company, legal entity or entrepreneur, as well as the executive director, director of the company or other legal entity (partners in a partnership), has not been convicted by a final judgment for any of the following criminal offenses: criminal association, creation of a criminal organization, giving bribes, receiving bribes, giving bribes in business operations, receiving bribes in business operations, evasion of taxes and contributions, fraud, money laundering, organized crime with elements of corruption, no older than 6 months before the date of the bid. "Submit bids, original or certified photocopy," the company points out.

Please note that if the bidder is a foreign company, legal entity or entrepreneur, it is necessary to submit a certificate from the home country, translated and certified by a court interpreter, no older than six months prior to the date of submission of the bid, original or certified photocopy.

"Original bank guarantee of the bid which must be unconditional, 'without objection' and payable on first call with a validity period of at least 120 days from the date of opening of bids. In the procedures for collecting bids (tender), the amount of the bank guarantee cannot be less than the initial (minimum) lease price," the public company points out.

When it comes to a natural person, provide personal information such as name, surname, address of residence, contact telephone number, as well as the offered price.

"A statement of acceptance of all conditions and obligations from the Public Invitation and tender documentation is also required, consent to the processing of personal data in the procedure - Form A of a public company, a photocopy of an ID card or passport with a unique identification number, a certificate from the administrative body responsible for the collection of tax revenues of Montenegro - the Tax Administration of Montenegro, confirming that the bidder has settled all due obligations based on taxes and contributions on the date of issuance of the certificate, or has been approved for a reprogramming of tax claims that are being paid regularly, which must not be older than 60 days from the date of submission of the bid, original or certified photocopy, a certificate from the competent authority for keeping criminal records - the Ministry of Justice, confirming that the natural person has not been convicted by a final judgment for any of the following criminal offenses: criminal association, creation of a criminal organization, giving bribes, receiving bribes, tax and contribution evasion, fraud, money laundering, organized crime with elements of corruption, no older than 6 months before the date of submission of the bid, original or certified photocopy," the company emphasizes.

Please note that if the bidder is a foreign citizen, it is necessary to submit a certificate from their home country, translated and certified by a court interpreter, no older than 6 months before the date of submission of the bid, original or certified photocopy.

"Submit the original bank guarantee of the bid, which must be unconditional, "without objection" and payable at the first call with a validity period of at least 120 days from the date of opening the bids. In the bid collection procedures (tender), the amount of the bank guarantee cannot be less than the initial (minimum) lease price. In addition to these mandatory conditions, each public call may also contain special criteria depending on the location and purpose of the lease, which bidders will be informed about when receiving the documentation. The conditions for leasing/using parts of the maritime domain are contained in each public call individually, starting with data on the location, minimum price, and information on the implementation of the procedures, evaluation criteria and details on opening the bids," the Maritime Domain concludes.
