The search of the office of lawyer Rodić, who is suspected of having committed the criminal offense of giving a bribe through incitement, was carried out illegally, according to the Bar Association.
The president of that chamber, Zdravko Beegović, explained that, according to the regulations of the Law on the Bar, the search of the lawyer's office cannot be conducted without the presence of the Chamber's representative.
"During the search of the law office of lawyer Goran Rodić, there was a gross violation of Article 23 of the Law on Advocacy. Namely, that provision stipulates that the search must be conducted in the presence of a representative of the Bar Association appointed by its president. Cases, files or documents, as well as findings obtained during the search of lawyers and law offices, cannot be used for the purpose of conducting proceedings against any party and law office," it was stated in the announcement of the Bar Association.
They also pointed out that the president of the Bar Association was not informed about the search of Rodić's office, so it was not possible to determine a representative of the Bar Association who would attend the search.
"It is obvious that the action of the search was carried out in an illegal manner and as such cannot be used as evidence in the procedural sense. On the other hand, we perceive this attitude of the prosecution as a form of arrogance and intolerance towards the legal profession as an independent and independent profession," Begović pointed out. in the statement, adding that they are sure that Rodić did not commit the crime for which he is charged.
