The state of Montenegro will pay damages to the company "BB Hidro" due to the termination of the concession contract for the construction of the small hydroelectric power plant "Slatina" on a part of the Slatina watercourse.
The company owned by Blaž Đukanović and Ivan Burzanović concluded the contract with the Government on May 25, 2017.
The verdict is not final and the parties have the right to appeal it to the Court of Appeal.
The Commercial Court's statement states that the claim of "BB Hidro" was partially accepted and the state was obliged to pay the company, as compensation for ordinary damages, the amount of 155.613,50 euros, with statutory default interest from April 1, 2024, the date of preparation of the findings and opinion of the economic and financial expert, until final payment, as well as the amount of 70.599,94 euros, based on statutory default interest calculated in the findings and opinion from the date of each individual payment until April 1, 2024, the date of preparation of the findings and opinion of the economic and financial expert, within eight days from the date of the finality of the judgment, under threat of forced execution.
"The remaining claim for compensation for ordinary damages, in excess of the awarded amount from paragraph two of the operative part of the judgment up to the requested amount of EUR 168.514, and for the amount of EUR 12.900, as well as for the accrued interest on the principal debt in the remaining portion over the awarded amount from paragraph two of the operative part of the judgment up to the requested amount of EUR 79.419,10, and for the amount of EUR 8.829,16, as well as for the requested statutory interest on the amount of EUR 12.900,00 starting from April 1, 2024 until final payment, was rejected as unfounded," the statement reads.
The request of "BB Hidro" requesting that the state be obligated to pay compensation for damages - lost profits in the amount of 1.410.915,93 euros was rejected as unfounded.
"According to the same judgment, the plaintiff is obliged to compensate the defendant for the costs of the proceedings in the amount of 10.647,88 euros, within eight days from the date the judgment becomes final, under threat of forced execution," the Commercial Court announced.
The aforementioned verdict is not final and the parties have the right to appeal it to the Court of Appeal of Montenegro.
