The Public Company for Coastal Zone Management cannot announce a tender for the lease of temporary facilities and catering terraces, as well as beaches that have been omitted from the tender published so far due to technical reasons, because since last Monday, when the four-year term of the director officially expired, this state-owned company has To young Mikiel, blockage because there is no authorized person to sign the documents.
This was confirmed to "Vijesti" by this public company.
"The Statute of the Coastal State does not define who can sign documents in the absence of the director, while with the expiration of Mikijelj's mandate, the authorizations he gave his assistants to sign documents in his name also expired," said a source in "Vijesti".
The company's statute (Article 9) stipulates that the company director may, in writing, transfer his or her powers of representation through a special power of attorney to another employee or authorized representatives. Article 10 of the statute stipulates that the company director may grant a power of attorney (power of attorney) to an employee with special powers with the consent of the Board of Directors, and the granting and termination of the power of attorney is recorded in the Central Register of Business Entities.
"Vijesti" is awaiting answers from the Ministry of Spatial Planning, Urbanism and State Property on what the Government, as the founder, will do to resolve this problem until the election of the director.
Tenders for finding additional temporary locations, restaurant terraces and swimming areas, as "Vijesti" was told, have been drafted and are just waiting for the director's signature.
Although it was expected that the Government session held on Thursday would include a proposal for the election of the executive director of the Coastal Zone, this did not happen, so this public enterprise is still without a leader.
Everything is happening in the midst of the opening of bids for the lease of bathing areas, which has stirred up the Montenegrin public. The paralysis of the public enterprise has also affected the verification of the legality of certain, primarily million-dollar bids for the lease of bathing areas that were submitted for the Budva beaches. Although the Coastal Zone has sent an invitation to the Special State Prosecutor's Office, as well as the Police Administration - the Financial Intelligence Unit (FIU), to investigate the origin of the money of the bidders who responded to the tender of this state-owned enterprise and who offered millions of dollars to the state for the lease of beaches, official requests could not be sent to these institutions, because there is no director responsible for signing the document.
This is precisely the reason why the SDT and FIU are still silent, and the Bid Evaluation Commission should finish its work as soon as possible and announce who has won the four-year lease of the beach. On the other hand, the "damaged" bidders expect the prosecution and police not to allow a repeat of the situation from a decade ago, when, using a similar model, phantom bids from agreed-upon bidders, the old tenants regained the lease of the beaches.
Last week, at a government session, an attempt to appoint Mladen Mikijelj for a second term caused a row, as the Prime Minister Milojko Spajic did not allow the item proposed by the Minister of Spatial Planning to be put on the agenda Slaven Radunović.
Spajić then reminded the coalition partners of the agreement that professionals, not party members, would be appointed to management positions in state-owned enterprises.
The Director of the Coastal Zone is appointed by the Government upon the proposal of the Personnel Commission, to which the Minister of Spatial Planning submits his proposal and the candidate's CV. Mikijelj was thus appointed by the Government four years ago. Zdravka Krivokapića and he retained that position even while three governments changed during his term.
Ferry repairs are also pending

Two days ago, Mikijelj also received support from the management of the Maritime and Coastal Transport Sector Morsko dobro and the newly formed "Union of Employees of JPMD - Ferries of Montenegro", who called on the Government to resolve the issue of the director of that state-owned company, who is the only one authorized to sign business documentation, as soon as possible.
The management and the union, which brings together 114 ferry line workers, state that the Maritime and Coastal Transport Sector is currently in the midst of preparations for the upcoming tourist season, that numerous activities are being carried out to prepare and equip their ships, and that preparations are underway to announce a tender for regular repairs of the ferries "Grbalj", "Teodo" and "Perast", whose seaworthiness certificates will expire in a few months.
In order to renew their certificates, the three ferries must undergo regular dry docks, repairs, and hull inspections, so contacts are underway with domestic and foreign shipyards that have expressed interest in bidding on the upcoming tender for ship repairs.
All tender documentation has been prepared, lists of necessary works have been made based on the requests of the Technical Inspectorate of the Maritime Safety and Port Management Administration, but the further procedure and timely completion of the overhaul, which are a key part of the preparations of the Maritime and Coastal Transport Sector for the season, have been called into question because there is currently no director who is the only one authorized to sign business documentation on behalf of that company.
