The public competition for the appointment of the President and two members of the Board of the Regulatory Agency for Energy and Regulated Utilities (REGAGEN) is not in line with the Energy Community (EC) acquis, announced the Director of the EC Secretariat, Artur Lorkowski.
"In the opinion of the Secretariat, the absence of criteria for the selection and appointment of candidates indicates that this public call is not in line with the acquis communautaire," Lorkowski stated in a letter sent to the President of the REGAGEN Board, Branislav Prelević, which the Mina-business agency had access to.
Prelević addressed the EC with a letter on April 8th, regarding the public competition announced by the Parliament on January 21st.
Lorkowski said that, after analyzing the letter and the attached documentation, they concluded that the competition contains conditions for the eligibility of candidates, such as Montenegrin citizenship and residence, a certain level of education in technical sciences, law or economics, as well as a certain duration of professional experience.
“However, we also found that the competition does not contain criteria for the selection and appointment of candidates, as expressly stipulated by the Electricity Directive, which has been adopted through the EU acquis,” said Lorkowski.
The article of that Directive, among other things, stipulates that members or top managers of the board of a regulatory body shall be appointed on the basis of objective, transparent and published criteria, through an independent and impartial procedure, which ensures that candidates possess the necessary skills and experience for the relevant position in the regulatory body.
