If the company "Eagle Hills", which ranked first in the tender for the lease of nine beaches on Velika Plaza, cancels the lease, in that case the collection of the bank guarantee would be activated.
This was officially stated to "Vijesti" by the Public Company for Coastal Zone Management, stating that the guarantees from the company "Eagle Hills" are worth around 600.000 euros.
"Vijesti" previously reported from unofficial sources that an Arab company had submitted bids for 19 beaches in Ulcinj with a total value of 1.884.125 euros.
Owner of Emaar Properties and Eagle Hills and investor Mohamed Alabar Last week, he said that he made a mistake in Montenegro when he applied for the tender for beaches in Ulcinj, that he currently does not have a project and that in the event of potential construction, everything will be done in accordance with the wishes of the local community.
Alabar added that he wanted to do a project for a nice beach bar, but that the financial estimate was bad, so he ended up with nine beaches, after which he decided to return them to the local community because he did not want to be in that business.
"The bids submitted by the company "Eagle Hills" were considered equally and in accordance with all applicable procedures, as were all other submitted bids. The documentation was complete and submitted on time, and the bids were valid for evaluation. After the evaluation and ranking procedure was carried out, the Public Enterprise's commissions made decisions according to which the company "Eagle Hills" was ranked as the first-ranked bidder for 9 out of a total of 19 locations for which it applied. The decisions were submitted to the bidders in a timely manner, and the continuation of the procedure is taking place in accordance with the prescribed deadlines and obligations arising from the selection decision. We are aware that it is possible for the first-ranked bidder to withdraw from the contract, in which case the collection of the bank guarantee would be activated. In accordance with the procedures, if withdrawal occurs, the Public Enterprise will proceed to conclude the contract with the second-ranked bidder," the Coastal Zone announced.
According to "Vijesti", none of the previous tenants of the nine beaches on Velika Plaza, which the company "Eagle Hills" has given up on, have yet to sign contracts with Morski dobro. They are reluctant to talk about it, and one of them, who requested anonymity, said that the deadline for signing a lease agreement for the beach is May 31st.
President of the Association of Beach Tenants in Ulcinj Prelja Škrelja He previously told "Vijesti" that "Eagle Hills" will probably cede the beaches to former tenants on the condition that they pay bank guarantees, which are not small and range over 100 thousand euros.
"With what they offered, those are huge numbers," said Škrelja.
Another source confirmed to Vijesti that "Eagle Hills" will likely seek payment of bank guarantees before finally giving up the lease.
The Coastal State Administration previously told "Vijesti" that there are no legal obstacles to the transfer of beaches if the first-ranked bidder decides to transfer management to third parties, including previous users, and that this is purely a matter of business agreement.
According to the Decision on Leasing Parts of the Coastal Zone, the lease price is paid in full upon conclusion of the use contract or in three installments, the first of which is due at the moment of conclusion of the contract, with the obligation to submit a bank guarantee to the Coastal Zone for payment of the remaining annual lease amount, increased by VAT.
Tender participants must, among other things, submit certificates that they do not owe the state any taxes and confirmation that they have not been convicted of any criminal offense.
Tender participants have the right to object to the Commission's decision within eight days from the date of receipt of the decision on the main matter, while the decision of the second-instance Commission on the objection is final.
According to "Vijesti", none of the previous tenants of the nine beaches on Velika Plaza, which the "Eagle Hills" company has given up on, have yet concluded contracts with Morski dobro.
The most favorable bidder is obliged to conclude the contract within 10 days from the date of receipt of the written invitation, and if Morsko dobro does not conclude it, it has the right to conclude it with another bidder in accordance with the placement of bids from the tender.
In the event of an equal number of points for all bidders, the tender will be declared unsuccessful for that location and a repeated public invitation will be conducted.
The Board of Directors of the Coastal Zone decided at the end of March to charge a guarantee to bidders with multi-million bids for beach leases if they reject the company's invitation to conclude a contract. And since that location does not conclude a contract with the second-ranked bidders, the tender for that beach will be repeated.
Morsko dobro called on both the prosecutor's office and the Police Department to react in these cases of multi-million bids due to suspicions that they were the result of collusion between the first and second-ranked bidders. The prosecutor's office did not react because, as "Vijesti" was unofficially told, no one from the prosecutor's office had officially filed criminal charges.
