The Administrative Court rejected the request of the Luxembourg-American company Corporacion America Airports (CAAP) to postpone the execution of the decision of the Concessions Commission of the Government of Montenegro.
This consortium requested that the state commission's decision be annulled, and the Administrative Court rejected its request as irregular.
"The Court finds that in the specific case, the Concessions Commission of the Government of Montenegro did not adopt an act that could be subject to postponement, but rather a decision that adopted the plaintiff's objection to the ranking list and returned the case for retrial and decision-making, i.e. to the state it was in before the ranking list of bidders was determined, so the plaintiff could not request a postponement of its execution, and since the request in question was submitted by the plaintiff's attorneys, who are lawyers, the Court rejected it in accordance with the provision of Article 21, paragraph 3 of the Law on Administrative Disputes.
On 19.09.2025, the plaintiff, through an attorney, filed a lawsuit with this court against the decision of the Concession Commission of the Government of Montenegro, number 01/97 of 01.08.2025, which returned the Ranking List of Bidders determined by the Tender Commission for the implementation of the concession procedure for the right to use the Podgorica and Tivat airports, business code number 01-011/24-3470/57 of 17.07.2025, in order to eliminate the identified irregularities.
"Having regard to the above, the Court did not prejudge the decision regarding the decision on the main matter of the lawsuit for the annulment of the disputed decision, but rather made a decision regarding the request for postponement of the decision in question, which, according to the court's ruling, could not be subject to postponement," the ruling, which "Vijesti" had access to, states.
In a lawsuit filed with the Administrative Court of Montenegro against the Tender Commission for the Award of Concession, CAAP requested that the actions of the Commission for the Award of Concession for Montenegrin Airports, which, as they believe, changed the scoring criteria under the influence of parties who are not members of the Tender Commission, be declared unlawful. They also requested that the Tender Commission's first evaluation of the technical bids be declared lawful and the only relevant one in this proceeding.
This means that the tender process for granting concessions to Montenegrin airports now continues and that the Tender Commission must act in accordance with the decision of the Concession Commission.
