Regarding the text "Notaries will not certify until problems with the new IRMS system of the Tax Administration are resolved", the Chamber of Notaries explains that the problem does not relate to the technical functioning of the IRMS itself, but to the normative incompatibility of the new laws.
The text refers to the inability to establish new companies in Montenegro through the IRMS system or to make changes to data for existing ones for a month and a half.
"The Chamber of Notaries did not problematize the technical functioning of the IRMS information system, nor did it condition the actions of notaries on the elimination of possible technical deficiencies in the system. The essence of the Chamber's point refers to the normative inconsistency of the new Law on Business Companies and the Law on Registration of Business and Other Entities, as well as to the imprecisely prescribed formats and procedures for electronic confirmation and submission of notarial acts to the register. It is precisely this normative imprecision that prevents notaries from acting legally secure and lawfully, regardless of the technical readiness of the system or the notary service. Notaries are technically and staff-wise fully prepared for electronic certification and digitalization of business, but their implementation requires clear and harmonized legal regulation. In order to objectively inform the public, we believe that it is important to distinguish between the technical aspects of the information system and the issue of legal compliance with regulations, which are essentially the subject of the Notary Chamber's point," the Notary Chamber stated.
