Budva Municipality and Parking Service ignored court decision: Slovinići's access blocked, they demand two million euros

The workers of "Parking Servis" did not let the truck pass, despite the fact that the lawyer for the Slovinić family, Nikola Kavedžić, and Goran Slovinić had previously informed the management of the municipal company about the court ruling.

Despite the decision of the Basic Court in Kotor, which adopted the proposal of the Slovinić family and their company "Anchor Company", and issued a temporary measure ordering the state of Montenegro, the Municipality of Budva, and the municipal company Parking Servis to allow construction machinery access to the construction site, where the Staromještane family began building a hotel with apartments for the market, the construction truck hired by Slovinić could not pass the ramp at the "Perla" building in Budva.

The truck waited for a full ten minutes for the ramp to be raised, but it was not allowed to pass. During that time, several trucks passed the ramp unhindered despite the decision to ban traffic on the promenade and contact zone of the Old Town in Budva.

The Slovinićs have begun construction of a multifunctional building on the site of two family houses, about a hundred meters from the Old Town, which is part hotel and part apartments for the market, the sale of which will finance the construction. The only way for construction workers to reach the construction site is through a section of the Slovenska Obala promenade, some 50 meters long, which has been prevented for eight months by the local administration, to which they have appealed, as well as all state institutions.

Kavedžić: Budva Municipality mocks court decisions

Attorney Kavedžić told reporters today that this kind of situation has not been seen in the recent legal, institutional history of Montenegro.

"Local government bodies do not respect, practically mock court decisions. They put themselves above the law, so to speak, suspending the application of the law. Since today it was impossible for construction machinery to reach the construction site, a procedure will follow through the bailiff who will allow us access to the construction site. So far, investors have suffered enormous material damage, the question arises as to who will pay for it. Given this arrogant behavior of the Municipality of Budva and Parking Servis, this damage will fall on the citizens," said Kavedžić.

He added that the state of Montenegro will also be responsible for the damage suffered by the investor, because it is the owner of the public road.

"Can you imagine that in the 21st century, the Municipality does not allow passage on a public road despite the existence of a court decision? Even the court stated in its decision that they were surprised by the Municipality's actions. We are announcing a lawsuit for compensation for material damage, which will ultimately fall on the state and citizens. In the end, the question of responsibility and who will be responsible for the damage arises. This is not just a question of the investor passing through a public road, this is a question of the functioning of the institutions of the system in general, the rule of law. Because, everything that is presented to the public that the institutions of the system function ideally, that it is great, wonderful, today all of that has fallen into disrepair," Kavedžić emphasized.

He called on Prime Minister Milojko Spajić, relevant ministers, prosecutors' offices, human rights defenders, international organizations, and diplomatic missions to get involved, in order to put a stop to what he called arrogant behavior.

Slovinić: Political revenge and Nikola Jovanović's great hatred towards our family

Local resident Goran Slovinić said that this is a political motive of the President of the Municipality of Budva, Nikola Jovanović, which is preventing them from implementing a project worth 14 million euros.

"This is about political revenge and Jovanović's great hatred towards our family: You saw today that other construction machinery passed the ramp unhindered, while our truck was blocked. This is about selective behavior and discrimination," Slovinić emphasized.

He said that he would file criminal charges against the director of "Parking Servis", Dragana Pima, for ignoring the court's decision.

"Today we have all witnessed a mockery of the state of Montenegro and the legal order. The Mayor and the director of the Parking Service, even though the court ordered them to do so, do not want to respect court decisions," said Slovinić.

He said that they have proper documentation, a building permit in accordance with the planning document.

"It is absurd that this same Municipality issued part of that building permit and gave the consent, which now blocks us from passing through the public road. It is interesting that the Mayor of the Municipality, Nikola Jovanović, is speaking before European parliamentarians in Strasbourg about human rights, and it is precisely in our example that these human rights are being violated," Slovinić pointed out.

Damage reaches two million, citizens of Budva will pay

Slovinić said that because they were prevented from building for a full eight months of the construction season, the damage reached two million euros.

"As our lawyer announced, a claim for damages will be filed. Unfortunately, this will fall on the citizens of Budva, which is not our goal and we are very sorry, since we are a family that has lived in Budva for more than 200 years and we love this city. However, the arrogant illegal decisions of the President of the Municipality of Budva will cost the citizens several million," Slovinić said.
