By deciding not to accept the appeal of the Civic Alliance for Changes in the obvious legal matter of violation of the Law on the Election of Councilors and Members of Parliament, the Constitutional Court experienced a complete legal and institutional failure, according to the SDP media pool.
"Contrary to the Law and its own previous decisions, the Constitutional Court, that is, the majority of its composition, has once again humiliated itself and the legality it protects under the Constitution. By voting that it is not necessary, as the law requires, that the voters must confirm with their signature that they have received the ballot, the judges of the Constitutional Court the courts did what even the members of the MEC from the DPS did not agree to," the announcement reads.
They add that MEC members "tried to preserve their professional dignity" by remaining restrained.
"Judges of the Constitutional Court are ready for more. As the Latin proverb says, the most responsible are the worst. It was not in dispute for the judges that the Constitutional Court decided the opposite in judgments in identical cases in Petnjica and Tuzi. Citizens see that they cannot be sure either that the highest judicial instance in identical cases will decide in the same way, which is the essence of faith in justice and in the state that must rest on justice. To decide differently on the same matter in just a few months shows that the majority in the Constitutional Court no longer tries to hide that it is working on a direct political order from the DPS", conclude from the SDP.
