The National Security Agency (ANB) should submit its analytical reports, in addition to the three highest Montenegrin officials, to the competent body of the Assembly, according to the Movement for Change (PzP).
MPs from that party Nebojša Medojević and Koča Pavlović submitted amendments to the proposed law on ANB, which the MPs will discuss at the session that starts on Tuesday.
We believe that we should put an end to the decade-long practice of exclusive information to only three people in the country and that the collected information should be put to the function of democratic development of society and strengthening the position of the Assembly
"We believe that we should put an end to the decade-long practice of exclusive information to only three people in the country and that the collected information should be put to the function of the democratic development of society and strengthening the position of the Assembly", stated Medojević and Pavlović.
MPs of the PzP believe that the current solution should be maintained, according to which a written request from the director of the ANB is necessary in order for the legal entities that keep the registers and data collections to provide the authorized person of the Agency with access to the data or provide him with the requested data, "as well as that this access, in order to protect the constitutional right to privacy, it must be implemented in accordance with the law".
It is stated that the proposed amendments to the Law on ANB foresee the right for its official to be able, at his own discretion, to access requested data from registers or data collections, without a written request.
"This opens up space for abuse and represents a step back compared to the existing solution," Medojević and Pavlović believe.
A candidate for ANB must not be convicted and can do other jobs only with the approval of the director
They proposed an amendment regarding the establishment of an employment relationship in ANB, specifying that a candidate for an official can only be a person who has not been criminally convicted.
Data on the property of each employee of the Agency and his family members are entered in his personal property card, which is created at the time of establishing the employment relationship.
"Data on the property of each Agency official and his family members are entered in his personal property card, which is created at the time of employment. The official is obliged to immediately report any change in property status," says the amendment of the PZP MP.
It is clarified that the control of the veracity of the data specified in the property registers is carried out by the Inspector General, who is appointed and dismissed by the Government.
"These provisions create a legal framework for the implementation of internal control in terms of preventing and fighting corruption," Medojević and Pavlović believe.
